BOARD OF ZONING APPEALS JULY 2, 1986 PAGE 2 <br />to Mr, Matheny. Chairman Remmel remarked that this should be an improvement. <br />C. Remmel moved to grant the special permit and also the 2' side yard vari- <br />ance, seconded by E. Graves, and unanimously approved. Variance granted. <br />4. T. Stergo, 23889 Lorain Road <br />Request for variance (1133.13). Request variance to install deck in front <br />set back (house is now encroaching)e Violation of Ord. 62-33, Section <br />1159.01. Also request special permit to add to non-conforming dwelling. <br />Special permission required Ord 62-33, Section 1231.02. <br />Ch.airman Remmel called all interested parties before-the Board. The oath <br />was administered to Mr. Stergo. Mre Remmel reminded Mr. Stergo that whan a <br />previous variance had been granted he had promised to clean up the back yard. <br />Mr. Stergo advised that it had been cleaned up at that time (his mother lived <br />there at that time) and now that he had moved in he was planning to clean it <br />up again during this construction. Mr. Stergo explained that he had enclosed <br />the porch previously and now he could not install a screen door since the <br />front door is_right at-the steps, this_deck would be less costly-than concrete <br />stoop- and -stepsa__ Mr. Bugala believed that a reasonable sized entry way could <br />be considered. Mr. Stergo stated that the existing steps now extend out 11' <br />(no further than the proposed deck) and that the new steps will come out to <br />the side. Building Commissioner Spino stated that if Pir. Stergo used the ex- <br />isting area that-the steps covered and constructed_new steps off the side, he <br />would need no variance. Mr. Stergo withdr.ew-- his request. Variance withdrawn. <br />5. Maurice 0'Grady, 23600 Cedarwood La. <br />Request for variance (1133,13). Request 7' rear yard variance for-patio <br />enclosure._ Violation of Ord. 62-33, Section 1.163.01. <br />Chairman--Remmel called all interested: parties before -the -Board:-- The oath -- <br />was administered to Mr. Kuenn, Patio Enclosures. Board had no problem with <br />the request, C. Remmel-moved to grant the variance, seconded by J. Relon, <br />and unanimously approved. Variance granted. 6. Mr, and Mrs. Wm. Menefee, 6173 Wild Oak Dr. <br />Request for variance (1133.13). Request 17° rear yard variance for patio <br />enclosure. Violation of Ord. 62-33, Section 1163.01. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Round, American Patio Rooms. Chairman Remmel questioned <br />the-site plan which shows a-45 foot rear yardm the rear set back should be 50'. <br />Mr. Roun3-stated that -he measured -to the -fence- which- could be set in from the <br />- property line? Board would like to know the exact variance needed and questioned <br />the location of a new shed on the property and if there was a building permit <br />for it. Itwas suggested that this request be continued until the next meet- <br />ing until these questions are resolved and they would like the owner present <br />at the meeting. R. Bugala moved to table the variance for Mr. and Mrs. Menefee, <br />seconded by E. Graves, and unanimously approved. Request tabled. <br />7, John W. Koglman, 27053 Butternut Ridge Rd. <br />Request for variance (1133.13).- Request 10' variance for distance between <br />deck and garage. Violation.of Ord. 62-33, Section 1151.04-C. <br />Chairman-Remme-l--called all interested parties_before the Board. -The oath was
