BOARD OF ZONING APPEALS OCTOBER l, 1986 PAGE 6 <br />No representative present. Motion made at end of ineeting to continue to <br />next month. <br />14. Gerald J. LaBanc, 4496 Dover Rd. <br />Request for variance (1133.13). Request 343 sq. ft. variance for garage area <br />to install patio off existing detached garage. Violation of Ord. 62-33, <br />Section 1151.04-G. <br />Chairman Remmel called all interested parties before the Board. Mr. <br />LaBanc was not present, but his neighbors Mr. and Mrs. Ibos came before the <br />Board. Proposal was explained to them and they had no objection. Motion <br />to continue the case was made at the end of the meeting. <br />15. Fretters, Inc., 26635 Brookpark Ext. <br />Request for variance (1133.13). Request variance from required 7' landscape <br />buffer between street right of way and parking area. Violation of Ord. 62-33, <br />Section 1213.04. Proposal approved by Planning Commission April 22, 1986 and <br />by Council May 7, 1986. <br />Chairman Remmel call a11 interested parties before the Board. The oath was <br />administered to Mr. Klein, architect, who explained that landscaped strip <br />between the sidewalk and the parking area was omitted from the plans which <br />have been approved; the building permit was issued; and the building and parking <br />area are under construction. Mr. Kline stated that they would install wheel <br />bumpers to keep cars from overhanging the sidewalk. Law Director Gareau stated <br />that wheel bumpers deteriorate quickly and that the green strip eliminates the <br />necessity for them. The fact that the plans were approved does not relieve <br />the developers from installing what is required by code. Mr. Kline stated <br />that there is a minimum of 10 feet of landscaping along the building. Mr. Grace <br />believes that there should be a sidewalk around two sides of the building. <br />This is not the purview of this Board. Law Director Gareau advised that if <br />they change landscaping to a sidewalk they would have to go back to the Plan- <br />ning Commission and other bodies for approval. Board agrees that the 7 foot <br />landscaped strip is necessary. R. Gomersall moved to grant the request to <br />Fretters, Inc., for a variance from required 7 foot landscape buffer between <br />the street right of way and parking area, seconded by C. Remmel. Roll call on <br />motion: Gomersall, Remmel, Bugala, Grace, and Helon, No. Motion failed to <br />pass. Variance denied. Regarding cases number 13 arid 14, C. Remmel moved to continue the two cases <br />which were not represented until the next meeting, those being Gerald LaBanc <br />and S. Katonka, seconded by R. Bugala, and unanimously approved. <br />Chairman Remmel requested that the Building Deparment advise all appellants <br />that they must be represented at the meeting and that they must display the <br />green "variance card" or their cases may be continued. <br />Board also wants any objections to variances to be signed, not anonymous <br />phone calls to the secretary. <br />It was also stated that Building Department employees should not tell appellants <br />that they will get variances.
