Grace, and unanimously <br />approved. Variance granted. <br />12. Gary Smith, 3436 Dawn Circle (heard at this point) <br />Request for variance (1133.13). Request 5'4" rear yard variance for addition <br />and greenhouse. Violation of Ord. 62-33, Section 1163.01. Also request <br />special permit to add to non-conforming dwelling (side yard). Special per- <br />mission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Smith and Mr. Midagliotti, contractor. Mr. Bugala <br />stated that he is concerned since this addition will only be a few feet away <br />from the garage. They pointed out that there is an existing enclosed porch <br />there now, it is in bad condition: and they will only be replacing what -is there <br />now. Garage is only 10' away from the house proper (not including the porch). <br />Mr. Grace believes that since porch is there now and is in such bad condition, <br />that this will be improving the property. Mr. Gomersall stated he could never <br />approve this since it would be a fire hazard. It was suggested that they move <br />the addition over. Mr.. Midagiiotti stated that this would not be too practical <br />since the patio door is only approximately 18" to 3'from the wall and a base- <br />ment window would be obscured. They also stated it would be too costly to <br />move the garage since it is in good condition. B. Grace moved to accept the <br />proposal as long as they move the structure to within 6" from the north side <br />of the double door going out of the back of the house, seconded by R. Bugala. <br />Roll call on motion: Grace and Helon, Yes. Bugala, Gomersall, and Remmel, No. <br />Motion failed to pass. Variance denied. Mr. Bugala stated that this was a <br />safety hazard, and believed that they should re-arrange their plans and come <br />back next montfi. <br />11. Andrew Mandilakis, 25755 Butternut Ridge Rd. (heard at this point) <br />Request for variance (1133.13). Request 92 sq. ft. variance for area of shed <br />and 1' height variance. Violation of Ord. 62-33, Section 1151.04-D. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Mandilakis who explained that when he picked up <br />the application from the Building Department no one told him that there were <br />limitations on the size of the shed and he was told that he could pour the slab <br />before he got his permit. He poured a 12' by 16' pad and has bought the lumber. <br />Had he known the size limitations, he would have conformed. Board has no pro- <br />blem with the location but is concerned with the size. Mr. Mandilakis asked <br />if they could at least have a variance to build a 10' by 12' shed so that he <br />can use three of the curbs on the pad. Mrs. Mandilakis pointed out that the <br />neighbors have no problems with the shed and she could contact them. Board <br />advised them that they could have an 8' by 12' shed. Mr. Mandilakis stated <br />that there should be some kind of procedure in the Building Department so <br />that people know what the ordinances are. C. Remmel moved to grant the 92 sq.- <br />fte variance for the shed and the 1' height variance, seconded by R. Bugala. <br />Roll call on motion: Remmel, Helon, Bugala, Gomersall, no. Mr. Grace, yes. <br />Motion failed to pass. Variance denied. C. Remmel moved to grant the location <br />variance to coincide with the cement platform which is now in existance in the <br />rear yard, seconded by R. Gomersall, and unanimously approved. <br />13. S. Katonka, 23197 Marion Rd. <br />Request for variance (1133.13). Request 16' front set back variance for foyer <br />and patio addition. Violation of Ord. 62-33, Section 1159.01.
