i
BOARD OF ZONING APPEALS SEPTEMBER 3, 1956 PAGE 2
Ord. 62-33, Section 1231.02.
Chairman Remmel called all interested parties before the Board. The oath ,
was administered to Mr. Koenning who explained he needs extra garage space
to store vehicles and yard equipment. This would be a 4 car garage, but
since addition is to the rear he would not be adding any more garage doors,
only a side entrance door. Lot is very deep. B. Grace moved to grant to
Harry Koenning, 26926 Buttemut Ridge Rd., the request for variance (1133.13)
request 228 square foot variance for garage addition, and this is contingent
upon a shed not being bui.lt in lieu of the garage addition being put up and
it cannot be used for public repair work and can only be used for parking
cars and garden equipment, seconded by R. Bugala, and unanimously approved.
Variance granted.
3. David Mortach, 4190 Bentley
Request for variance (1133.13). Request 253?j ft. rear yard variance for patio
enclosure. Violation of Ord. 62-33, Section 1163.01.
Chairman Remmel called all interested parties before the Board. The oath
was administered to Mr. Martin, Mrs. Mortach, Mrs. Kelly, Mrs. Currin and
her son, Mr. Currin. Chairman Remmel stated that this is a 15' by.30'
patio and is ezKeeptionally large. Mrs. Kelly, a neighbor from across the
street, had no objection. Mrs. Currin who lives next door objected to the
size because it would take away from the openess of the rear yards and
could be a security problem. Mr. Martin presented a revised plan for a
13''by 22' patio, but he would also like to continue the roof over the
staiiwell. Board prefers the 22' by 13' structure without continuing the
roof. C. Remmel moved to grant the variance for a 13' by 22` patio screened
enclosure, seconded by R. Bugala, and unanimously approved. Variance granted.
4. R. T. Robitaille, 5772 Forest Ridge Dr.
Request for variance (1133.13). Request 8'6" rear yard variance for patio
enclosure. Violation of Ord. 62-33, Section.1163.01.
Chairman Remmel called all interested parties before the Board. The oath
was administered to J. LaRussa, contractor. Board questioned why roof of
patio was under construction. He explained that they were building an ad- .
dition which did not require a variance and the carpenter started to b uild
the roof without.his knowledge. He has stopped work on the roof. Board has no problem with the variance but would like the Building Commissioner
to review the contractors record and see if he has had any previous viola-
tions. They questioned if license should be revoked. Law Director Gareau
advised that it would be up to the Board of Building Code Appeals to revoke
a contractor's license. C. Remmel moved to grant the 8'6" rear yard vari-
ance for a patio enclosure, seconded by R. Bugala, and unanimously approved.
C. Remmel moved that the Kingsman Construction`s record be reviewed with
the Building Code Appeals Board to make sure this is noted on their record
and,if there are any other violations, we request that they take appropriate
action, seconded by R. Bugala, and unanimously approved. Variance granted.
5. United Dairy Farmers, corner of Lorain and Columbia Roads.
Request for variance (1133.13). Request 14' set back variance for canopy
(50' required) on Lorain Rd. Violation of Ord. 62-33, Section 1174.01.
Also request 6' set back variance and 5' set back variance for canopy (25`
required) on Columbia Road. Violation of Ord. 62-33, Section 1174.03.
