<br />BOARD OF ZONING APPEALS SEPTEMBER 3, 1986 PAGE 5 <br />12. Gerald Reitz, 27189 Bellevue Dr. <br />Request for variance (1133.13). Request 7'3" rear yard variance for patio <br />enclosure. Violation of Ord. 62-33, Section 1163.01. <br />Chairman Remnel called all interested parties before the Board. The oath <br />was administered to D. Neuberger, contractor. Board had no questions on <br />proposal. R. Bugala moved to grant the 7'3" rear yard variance for a patio <br />enclosure for Gerald Reitz, 27189 Bellevue Dr., seconded by J. Helon, and <br />unanimously approved. Variance granted. <br />13. Leonard Fink, 28300 Nandina Dr. <br />Request for variance (1133.13). Request 1' height variance for fence (instal- <br />led). Violation of Ord. 62-33, Section 1221.06. <br />Chairman Remmel called a11 interested parties before the Board. The oath <br />was administered to Mrs. Fink who explained.th at they had had.problems_ <br />because the vacant house beind them was a hang out for children. Mr. Fink <br />had installed the fence.to keep vandals out of their yard. A variance had <br />been denied previously and Board agreed that a 5' fence would be sufficient. <br />Mrs. Fink do.es not believe that a 5' fence.would keep them from looking into <br />their family room door. -She stated that none of their neighbors had complained <br />about the fence. C. Remmel moved to grant the variance, seconded by R. <br />Gomersall. Roll call on motion: Remmel, Gomersall, Bugala, Grace, and Helon, <br />No. Motion failed to pass. Variance denied. C. Remmel moved that this go <br />to the Building Department for investigation and citation, seconded by R. <br />Bugala, and unanimously approved. <br />14. Tony Roma's, 26092 Great Northern Shopping Center. <br />Request for variance (1133.13). Request 22 sq. ft. variance for sign area. <br />Violation of Ord. 62-33, Section 1221.06. <br />14. Chairman Remmel called all interested parties before the Board. The oath <br />iwasadministered to Mr. Nelson, Biskind Development, Lee Wolf, the owner, <br />and a representative of Boyer Sign Co. It was explained that there were <br />three signs and the total of those three signs is 22 square feet over the <br />allowed signage. Building Commissioner Spino explained that this varianCe <br />is only for the amount that is allowed for the restaurant and will not be <br />reducing the area for the other units in the b uilding. Board viewed the <br />renderings of the signs. Board is concerned that the total sign area <br />allowed is for the entire building, not just the restaurant area. C. Remmel <br />moved to grant the 22 square foot variance based upon the premise that it <br />was calculated based upon the frontage for Tony Roma's only seconded by R. <br />Gomersall, and unanimously approved. Variance granted. <br />15. John Goggin, 26888 Sweetbriar <br />Request for variance (1133.13). Request 3'6" rear yard variarice for patio <br />enclosure. Violation of Ord. 62-33, Section 1163.01. <br />Chairman Remmel called al-l interested parties before the Board. The oath <br />was administered to Mr. Goggin. Board had no problem with the request. <br />- R. Bugala moved to grant the 3'6" rear yard variance for the patio enclosure <br />at John Goggin's at 26888 Sweetbriar,_ seconded by R.
