? •. y <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - MAY 7, 1986 <br />Chairman Remmel called the meeting to order at 7:30 p.m. <br />Present: R. Bugala, R. Gomersall, E. Graves, and C. Remmel <br />Absent: J. Helon <br />R. Bugala moved to accept the Minutes of the April lOth meeting as written, <br />seconded by E. Graves, and unanimously approved. <br />Hennie Homes, property located west of John Knox Church (25200 Lorain Rd.) <br />and east of proposed relocated S.R.252. <br />Request for variance (1133.13). Request 25' set back variance from S.R.252 <br />(.50' set back determined for both S.R. 252 and Lorain Ro.ad.. per ruling of the <br />Law Dept). (Proposal denied by Planning Commission September 24, 1985). <br />(Continued from Board of Zoning Appeals December 4, 1985). <br />Chairman Reuimel called all interested parties before the Board. The oath <br />was administered to the Reverand Blasius and W. Geisser, attorney, from <br />John Knox Church; Erank T2oss, attorney, A. Bender, architect, and P. Zwick, <br />engineer, allrepresenting Hennie Homes. Variance request has been re- <br />duced to 20 feet, Mr, 1KOSS read a copy of a letter from the Ohio Department <br />of Transportation to City Engineer Schaller stating they the State had re- <br />moved objections to the proposal and that the revised plan reflects conditions <br />of their acceptance (letter included in file). The Reverand Blasius has <br />concezns regarding traffic turning left into this property since the turning <br />lane is usually stacked with cars turning left into Great Northern Blvd. <br />Church driveway is further east and they have that problem now. This should <br />be an issue for Planning Commission. When S.R. 252 is constructed Lorain <br />Road driveway-will be eliminated and entrance will be on 252. Mr. Moss <br />stated that they had originally disagreed with the Law Directors opinion <br />that a 50' set back was required on both Lorain Road and 252, however, not <br />granting this variance would be denying the owner of his property rights. <br />Mx. Geisser maintained that a smaller building could be built on this pro- <br />perty which would not require a variance. C. Remmel moved to grant the vari- <br />ance for a 20' set back as requested with the condition that this variance <br />is predicated upon approval by the Planning Commission and the Safety Dept., <br />seconded by E. Graves. Roll call on motion: Reummel, Graves, and Bugala, <br />yes. Gomersall, No. Motion carried. Variance granted. <br />Elias Brothers Restaurant, 26770 Lorain Rd. <br />Request for variance (.1133.13). Request 15' front set back variance to con- <br />struct greenhouse addition. Violation of Ord. 62-33, Section 1174002. (Vari- <br />ance previously denied January 2, 1985).
