<br />_ <br />BOARD OF ZONING APPEALS MAY 7, 1986 PAGE 4 <br />and that this lot has no other use except residential. Mr.,Bugala stated <br />that Mr. Bauer, as a developer, should have been aware of what he was buying, <br />.and that a 30' variance would be required to build a house on this lot; and <br />that the neighbor to the side would be looking at the back of the house. It <br />was also explained that when the variance was granted in 1980, the Board <br />thought it was a legally subdivided lot and at a later meeting there were <br />objections from neighbors. R. Gomersall moved to grant the request for the <br />variance to subdivide the property as requested, seconded by R. Graves. Roll <br />call on motion: Gomersall, yes. Graves, Bugala, and Remmel, No. Motion <br />failed to pass. Variance denied. <br />4. Eugene R. Haettich, 23598 Marion Ave. <br />Request special permit to ratse roof on non-conforming dwelling. Special <br />perm3:ssion required Ord. 62-33, Section 1151.04H. <br />Chairman Remmel called all 3:nterested parties before the Board. The oath was <br />administered to Mr. Haettich who explained he needed more room upstairs. Mr. <br />Bugala asked if raising the roof was a viable proposal. Building Commissioner <br />Spino stated that it is within the use of the code. C. Remmel moved to grant <br />the special permit, seconded by E. Graves, and unanimously approved. Special <br />permit granted. <br />5. Harold E. Chinn, 4219 Lisa Lane <br />Request for variance (1133.13). Request 1 foot variance for fence. Vio- <br />lation of Ord. 62-33, Section 1151,04H. <br />Chairman Remmel called all interested parties before the Board. The oath was <br />administered to Mr. Chinn who explained that his neighbor has a pool and it <br />would be visible-over a 5' high fence, The pool is not directly behind Mr. <br />Chinnts property. E. Graves moved to grant the request for a 1' variance for <br />a fence for the property•located.at 4219 Lisa Lane, seconded by R. Bugala. <br />Roll call on motion: Graves, Bugala, Gomersall, and Remmel, No. Motion failed <br />to pass; Variance denied. <br />r <br />6. David V. Kenyon, 23356 Ulmsteu Dr. ' <br />Request for variance (1133.13). Requeat 1 foot variance for fence. Vio- <br />lation of Ord. 62-33, Section 1151.04-H. <br />Chairman Retnmel called all interested parties before the Board. The oath,was <br />administered to Mr. Kenyon who explained that his property is low and garage <br />foundation is washing away; he plans to raise the grade and the 6' fence <br />will afford more privacy for him and his neighbor who has a pool. Board agrees <br />that a 6 foot fer.ce wTll not solve his water problems. He was advised he could <br />have 16 feet of a 6' privacy screen if it is locted 5' off property line. <br />C. Remmel moved to grant this variance, seconded by E. Graves. Roll call on <br />motion: Remmel, Graves, Bugala, and Gomersall, No. Motion failed to pass. <br />Variance denied. <br />7. Clyde R. Whitehouse, 25702 Byron Dr. <br />Request for variance(1133.13). Request variance for picket fence (not 90% <br />open) on corner 1ot. Violation of Ord. 62-33, Section 1151.04-C. <br />Chatrman Remmel called alT interested parties before the Board. The oath was <br />administered to Mr. Whitehouse and a neighbor, Mr. Latimer, who was concerned <br />that pointed pickets would be dangerous; and also believes that this type fence
