ti <br />r ?. <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - MARCH 5, 1986 <br />Chairman Remmel called the meeting to order at 7:40 p.m. <br />Present: R. Bugala, R. Gomersall, E. Graves, J. Helon, and C. Remmel <br />Also Present: Law Director Gareau, Building Commissioner S. Spino, Council- <br />members J. Saringer, D. McKay, R. Wilamosky, and W. Lackey <br />and Recording Secretary B. Oring <br />R. Bugala stated that on page 3, motion regarding Georges Kitchen should <br />read "reduce parking lot lines to 82 feet by 20 feet.." R. Bugala <br />moved to accept the Minutes of of February 5, 1986 as amended, seconded <br />by E. Graves, and unanimously approved. <br />Space Age Industrial Design, 30817 Bradley Rd. <br />Referred to Board of Zoning Appeals by virtue of Section 1193.03. Request <br />70' variance for location of build-ing (side yard set back). Violation of <br />Ord. 62-33, Section 1195.03. Request 30' variance from building to buffer. <br />Violation of Ord. 62-33, Section 1194.03. No record of structure existing <br />in buffer (Violation of Ord. 62-33, Section 1193.03.) (Continued from <br />February S, 1986). <br />Chairman Remmel asked that only the principals involved and one representative <br />for the neighbors come before the Board and also requested that any discussion <br />be limited to items not previously presented. Mr. Hevelone, representing the <br />neighbors, stated that there were some residents who had not appeared before <br />who would like to speake The oath was administered to Mr. Hardy, Space Age; <br />G. Hotz, his attorney; Mrs. Szabo, a resident of Bradley Road; M. Godfrey, L. <br />Maximuk, J. Bonner, and J. Hevelone, residents of Timber Trails; and Council- <br />members, W. Lackey, D. McKay, R. Wilamosky. Mr. Hevelone stated that since <br />the zoning lines have been determined and since this property is not zoned <br />entirely Limited Tndustrial, the variances requested should be changed and <br />are out of order. Mrs. Szabo, who lives one lot removed from Space Age, ob- <br />jected that she was not notified of the meeting, especially since her property <br />was mentioned at previous meetings. She further explained that when she pur- <br />chased her property, it was all zoned residential and that the zoning was <br />subsequently changed to Limited Industry; she is aware that her lot has mixed <br />zoning and does not want the zoning lines changed. She is objecting to any <br />expansion, especially in view of the parking and traffic problems this busi-_ <br />ness is causing at present. The Chairman explained that this Board has no <br />authority to change the zoning line and that by the ordinance, it was not <br />required that she be notified. Mr. Hotz stated that his client is being de- <br />nied the use of his property by this mixed zoning; that the zoning should <br />conform to property lines; and this problem should be addressed by the City. <br />Mr. Godfray, a civil engineer, has plotted the property based on Engineering <br />Department data and presented a map showing where present building is located <br />in relation to zoning lines, buffer areas, and property lines; and showing <br />that Space Age has only 52' befo-re infringing on the buffer zone.
