<br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - FEBRUARY 5, 1986 <br />Chairman Remmel called the meeting to order at 7:40 p.m. <br />Law Director Gareau administered the oath of office to Mr. Helon for <br />his new term. <br />Present: R. Bugala, R. Gomersall, E. Graves, J. Helon, and C. Remmel <br />Also Present: Law Director Gareau, Councilwoman J. Saringer, Acting <br />Building Commissioner D. Sanker, and Recording Secretary <br />B. Oring <br />Mr. Gomersall corrected the Minutes of January 2, 1986 to reflect that he <br />was in attendance. R. Bugala moved to accept the Minutes of the January <br />2ndmeeting as amended, seconded by E. Continued from <br />January 2, 1986. <br />Cha.irman Remmel xequested that only one person speak for the zesidents of <br />Timber Trails Subdi°vision and asked that only new thoughts on the proposal <br />be presented. Mr. Hevelone, the spokesman, and'Mr. Hardy, owner of Space <br />Age, came before the Board. Mr. Hevelone read a prepared statement (included <br />in file) reiteratimg the neighbors' objections to the variances requested, <br />and urging tlie Board to reject the request and uphold the ordinances as <br />written since the intent of those ordinances are to protect and buffer the <br />residential areas from the Industrial areas. They maintain that the qual- <br />ity of their life and their property values will be adversly effected by <br />this proposal, They also suggested that since this lot is less than the <br />required 200 foot width, another variance should have been required (Sec- <br />tion 1195.04). They advised the Board that according to the zoning map <br />shown to them in the Engineering Department the zoning line runs through <br />the property imrol?ved and some adjacent property and these lots are only <br />partially Industrial, with a rear portion of them residential, thus in- <br />creasing the encroachment. They pointed out that as far back as 1957;a:= <br />City zoning-map shows a 501 buffer area around the perimeter of the Indus- <br />trial Area, and this is a perimeter lot. They refuted statements made <br />by tfie Board at the last meeting that they are newcomers to the neighbor- <br />hood, and advised that,Mr, Havelone and Mr. Bonner (directly adjacent to <br />this property) both contracted to purchase their homes prior to Mr. Hardey's <br />purchase of hi:s property in August, 1984, and stated that Mr. Hardy should <br />have been aware of the xestrictions required in the Industrial Area when <br />tfiat property is adjacent to residential property. Most of the homeowners <br />were aware of the proximity of the Industrial Area, but believed that the
