Mr. Dubelko stated <br />that since building is 10' off residential property line and is legally <br />non-conforming, any expansion would need a special permit from the <br />Board of Zoning Appeals. Mr. and Mrs. Szabo, property owners on Bradley <br />Road, gave a history of the properties involved and stated that they <br />are concerned that there would not be enough room on this property for <br />parking. They have problems with cars parking on the street now. Mr. <br />Hevelone and Mr. Godfray, of the Timber Trails Home Owners Association, <br />presented a drawing which plotted the properties and indicated a small <br />triangular area in which building could be constructed and still conform <br />to code. Mr. Hevelone as spokesman for the Homeowners gave the following <br />reasons for their objections: 1) f actory will be in an area which is res- <br />idential in character; 2) codes which require buffers should be enforced; <br />3) Mr. Hardy bought property in August, 1984 and should have been aware <br />of code restrictions; 4) requested rezoning will not enable him to <br />build legally on property; 5) water pressure in area is not adequate <br />for proper fire protection as it is now; 6) roads in area could not <br />hold up under the truck traffic generated by this expansion 7) property <br />values would be decreased 8) City has designated Limited Industrial <br />areas and these should be developed. He concluded by stating that this <br />rezoning would be totally inappropriate in this area. Mr. Kipp, who is <br />involved with the soccer program in the city, stated that such a factory <br />could present a hazard to the people using the soccer fields and the <br />proposed baseball diamonds. Mr. Thomas from Timber Trails and a member <br />of the-Chamber of Commerce urged the Commission to make a commitment <br />to the fair and consistent development of the west side of North Olmsted <br />and suggested that this business could be relocated in the designated <br />Industrial Park. Mr. Bonner and-Mr. Maximuk, also of Timber Trails,-,cand 30' set bacl <br />supported Mr. Hevelone's statements and requested that there not be and concluded <br />"shot gun rezoning". Chairman Burns quoted Section 1194.02 which re-_ <br />quires a.50T buffer/*and concluded that these requirements would make these lots virtually unbuildable. Mr. Spi.no believed that this area is <br />not an Industrial Park District, but should be considered as a Limited <br />Industrial Area. Mr. Dubelko advised that the Limited Industrial Park <br />District is the total land zoned Limited Industry. Commission discussed <br />this matter further and concluded that even with the rezoning this business <br />could not be expanded within the codes and the lot was virtually un- <br />buildable; and concluded th at this area has a"hodge-podge" zoning at <br />present and this rezoning would not solve the problem and would just serve <br />a particular interest. _ <br />T. Morgan moved that the rezoning request where the rear yard crosses <br />233-6-8 and 2?3-6-19 be approved as submitted, seconded by J. Burns. <br />Morgan, Burns, Bierman, Gorris, Traczyk, Wixted, and Brown, No. Motion <br />failed to pass. Request for rezoning is denied. <br />V. COMANNICATIONS: <br />Annual meeting of Regional Planning on April 17, 1986. <br />Vi. NEW BUSINESS: <br />Mr. Morgan requested that a letter be written to the Architectural <br />Board of Review regarding their requesting developers to re-submit. <br />certain items to their Board instead of to the Planning Commission. <br />He suggested that they express their concerns in their minutes and <br />require the developer to address them at the next Planning Commission <br />meeting.
