PLANNING COMMISSION OCTOBER 14, 1986 PAGE 4 <br />Mr. C. Andreano, engineer, presented plans for the 21 sublot sub division <br />explaining that the area is zoned "B" residential but the lots will con- <br />form to the "A" residential requirements. Development is adjacent to <br />the Cleveland Metro Parks property on three sides. Mr. Andreano stated <br />that he had just been advised that the length of the cul-de-sac does <br />not conform to the ordinance. Chairman Burns read a letter from Stephen <br />D. Coles, Chief of Park Planning, Cleveland Metroparks System objecting <br />to the proposal (see letter attached). Mr. Andreano responded that <br />they were aware of the drainage problems and would rectify them and <br />meet all the ordinances of the City regarding sewers and drainage. City <br />Engineer Schaller stated that property must be drained and must meet all <br />code requirements. Mr. Andreano also advised that the Metroparks have <br />not purchased any restrictive provisions on this property. Assistant <br />Law Director Dubelko advised that since the cul-de-sac is non-conforming <br />by ordinance, they would have to approach the Council for a variance <br />and advised that Planning Commission could approve subject to Council's <br />approval of tlie cul-de-sac. Mr. Nenadal, owner of the property to the <br />rear (facing Barton Road) also questioned the drainage and how it would <br />affect his property and was advised that drainage would be addressed <br />with the submission of the final plans. In reference to statements <br />made by the park board, Mr. Needles, the developer, responded that that <br />li:o.ard should not speak for the Cuyahoga County Board of Health and <br />those statements should not be considered. Law Director Dubelko stated <br />that the Commission is required to act upon only what is required by <br />the subdivision ordinance. J. Burns moved to approve the preliminary <br />plan for the Bradley Oak Estates Subdivision contingent upon Council <br />granting a variance for the cul-de-sac exceeding the 500' requirement, <br />seconded by R. Bierman, and unanimously approved. <br />2)- DiBenedetto Property Split (heard at this point) <br />The proposal is to realign the property lines of permanent parcels <br />232-26-10, 232-26-11, and 232-26-38 by adjusting property lines and to <br />extend- the Brookpark Extension rigli:t of way approximately 125' eastward. <br />The property is zoned Retail Business, General. <br />Mr. DiBenedetto explained that this section of .road was put in by Best <br />and Company with the approval of the City when their property was devel- <br />oped. Assistant Law Director Dubelko explained that this road would <br />have to be brought up to code in order to be accepted by the City. Mr. <br />DiBenedetto will withdraw the request to extend the Brookpark right of <br />way. Regarding just the subdivision, sub lot 1 is the property where Nam <br />Wah Express is located and sublot 2 is the site of Aamco and internal <br />lot lines are being re-aligned; lots will not be made smaller. If road <br />is not to be dedicated then the southern line of sublot 2 could be ex- <br />tended to the southernmost line of the roadway. R. Bierman moved that <br />the proposal to realign property lines, permanent parcels 232-26-10, <br />232-26-11, and 232-26-38 by adjusting property.lines be approved with <br />the notation that the northern line of the indicated extension of <br />Brookpark Road will not be an existing property line, seconded by E. <br />Traczyk, and unanimously approved. <br />V. COMMUNICATIONS: <br />Ordinance 86-92, an ordinance amending Section 1231.04 of the Zoning Code.
