? _+ CITY OF NORTH OLMSTED BOARD OF ZONING APPEALS MINUTES - SEPTEMBER 4, 1985 Chairman Remmel called the meeting to order at 7:35 p.m.. Present: R. Bugala, R. Gomersall, E. Graves, J. Helon, and C. Remmel Also Present: Law Director M. Gareau, Building Commissioner E. Gundy and Recording Secretary B. Oring. Chairman Remmel announced that case number 4, 7515 Company and the con-_ tinued case, Marathon Oil Company would be heard at the end of the meeting. 1. Nancy C. Hastings, 5675 Allandale Dr. Request for variance (1133.13). Request 14'6" rear yard variance for roof over deck. Violation of Ord. 62-33, Seetion 1163.01. ?,- Chairma.n Remmel called all interested parties before the BQ?d_._._ The oath was administered to Mr. I:aJoe and Mr. Zvaigzne, neighbors-on either side of the 2ppellant=and to Ms: Hastings and a friend.- Both°neighbors objeeted-- to the proposal because the roof will detract from the appearance of the neighborhood, since all the back yard properties are open and park-like. They feel roof looks like a car-port. Mr. Bugala stated that deck is ex- tremely high; deck is legal according to the Building Commissioner. Ms. Hastings stated that the builder had told them that there would be no problem with the deck and roof. Mr. Bugala moved to approve the request for a 14'6" rear yard variance for a roof over the deck at the Nancy C. Hastings residence at 5675 Allendale Dr: Roll call on motion:--Bugala, - Graves, Gomersall, Helon, and Remmel; Nay. Motion failed to-pass. Vari- ance denied. 2. Little Caesar's Restaurant, 23144 Lorain Rd. Request for variance (1133.13). Request 14 sq. ft. variance for wall sign. Violation of Ord. 62-33, Section 1221.06. Chairman Remmel called all interested parties before the Board. The oath was administered to Mr. G. Hajj, owner of the restaurant and C. Woost, sign contractor. This is a new strip shopping center, and sign will be individual neon letters with a logo. Mr:.Bugala has a problem with re- quest because this is the first sign.in the shopping center and granting this variance will'encroach on the sign area allowed for the other units, as has happened in the past. Building Commissioner Gundy stated that this would happen unless the Board specified that they will be giving additional sign area.to the entire strip. Logo of sign can be removed. R. Bugala moved to grant the request for'a 14 sq. ft. variance for wall signs for Little Caesar's Restaurant at 231.44 Lorain Road, seconded by C. Remmel. Roll call on motion: Bugala, Remmel, Gomersall, Graves, and Helon, Nay. Motion failed to pass. Variance denied. 3. Mr. & Mrs. Daniel A. Manik, 5798 Fitch Rd. Request for variance (1133.13). Request variance for location of tool shed. Violation of Ord. 62-33, Section 1151.04-D.
