? <br />BOARD OF ZONING APPEALS JUNE 24, 1985 PAGE 3 <br />that parking right up to the side walk is a dangerous situation for their <br />children. Tt was explained that customers can legally park in the set back <br />(7' landscaped buffer is required), Mr. Halleen stated that since other <br />companies display cars in front, he must stay competitivea There wer.e also <br />many complaints about the loudspeakers that can be heard from his other lot <br />on the north side of Lorain Rd, and such a system at this location would <br />be even more audible. It was suggested that he use a beeper system. Mr. .. <br />Halleen will look into this. Councilman Wilamosky was sworn in at this time. <br />Mr. Halleen agreed to install a solid 6' fence along the adjacent residen- <br />tial property line. He is not planning to have a repair shop on this lot. <br />Residents would like a buffer zone between the lot and their property (lot <br />is to be paved right up to the property line) and ligliting which will not <br />shine on their property. Chairman Remmel stated that property was General <br />Retail and-that-the Board is only-discussing-the variance-requested at this <br />time. Councilman Wilamosky restated the residents complaints regarding <br />the speakers, lighting, etc. He said that these concerns should be con- <br />sidered-when-granting the variance, and suggested that the Board require - <br />some-ty_pe-of green area - to. the rear,==and must-consider that- a - 8 or• 1-0' - <br />van or:truck could be seen over a six foot fence.--He suggested that the <br />City should require more.green area-when developing--the western end of the <br />town.- Mr. Graves suggested that-Council should pass such ordinances.- Law <br />Director Gareau advised_that_the display vehicles would have to be parked <br />behind the 7' front green area that is required and that this Board cannot <br />require other green areas as a condition of this variance. He stated that <br />other variances to display cars in front set back have been granted re- <br />cently. The issue of green areas is an item for Planning Commission and <br />this Board has _no._right _ta r-equire-them-.--He a-1-so-explained - that even- <br />though-the -1ot is-less-than 150', two legally non-conforming lots are being <br />combined to make one less non-conforming lot and that no variance- is needed - <br />to an_this acco-r.ding--to--the-eode. After- some-discussion-Mr-: -Halleen--agreed -- <br />to install a 10' frontlandscape buffer instead of the 7' required. Council- <br />man Wilamosky suggested that the Board deny Mr. Halleen's request unless <br />he provided more green area in rear of lot. -A neighbor stated that-Mr. . <br />Halleen was in violation of Section 1173.01 since there will be a situation <br />which is injurious to the surrounding area because of noise and danger to <br />residents. This is not a matter for this Board. C. Remmel moved to approve <br />the variance to display vehicles in the front 50' set back provided that a <br />10' green area be maintained, seconded by R. Gomersall, and unanimously <br />approved. Variance granted. <br />Meeting was adjourned at 8:55 p.m. <br />C. Remmel, Chairman B. Oring, Rec6,,fding Secretary
