?PLANNING COMMISSION JANUARY 8, 1985 PAGE 5 <br />Proposal is for sixteen (16) sublots and includes extension, realign- <br />ment and vacation of a portion of Elm Road within the development site. <br />City Engineer Schaller explained proposal to subdivide property into <br />16 sublots and use right-of-way belonging to the State of Ohio which <br />can be released to the City, if the City requests it. A letter from <br />the Ohio Department of Transportation from Kenneth J. Seifert, P.E., <br />Right of Way Engineer - District 12, stated in part that "Although <br />the State would prefer to convey all the right of way it purchased for <br />relocated Elm Road to the City at one time, I feel it would be possible <br />to convey only that portion which would be dedicated as part of said <br />proposed subdivision, if a request is made by the City". It was noted <br />that sublot 16 is an oversized lot. Proposal was explained to adja- <br />cent property ownerso They questioned what would happen to the remain- <br />der of the right-of-way (could Mr. Clingman come back later to develope <br />that portion?); what problems abandoning a sewer line would cause. They <br />doubted that he owned all property involved. Mr. Schaller explained <br />that State owned right-of-way could be given to the City and used for <br />street purposes only, and that existing sewer line would have to be re- <br />located. Mr. Clingman stated that he owned or had options on all pro- <br />perty involved. Mr. Morgan questioned interpretation of code relative <br />to the 500' limitation of a cul-de-sac. T. Morgan moved to table pro- <br />posal to the next meeting and request that the Law Department give its <br />interpretation of the cul-de-sac length working with the Engineering <br />Department scale so that we know, in fact, that this is considered a <br />cul-de-sac of more than 500' and if this is a continous road or not, <br />seconded by J. Wixted, and unanimously approved. <br />V. COMMUNICATIONS: <br />Letter from D. Biskind, Biskind Development Company, inviting member to <br />an informal meeting on January 10, 1985 from 6 to 8 p.m. to discuss future <br />proposals. <br />Letter from J. Metzger, St. Richard's Parish Council regarding their ob- <br />jections to the Self Service Maxi Wash proposal which was before the <br />Board of Zoning Appeals and will be coming before the Planning Commission <br />at a later date. <br />Letter from Mayor Swietyniowski and a copy of a letter from D. Biskind <br />regarding a meeting on January 19, 1985 at 9:00 a.m. and requesting a <br />Planning Commission representative to take part with other representa- <br />tives and with N.O.A.C.A. to discuss a strategic transportation planning <br />study. Mr. Burns and Mr. Morgan will attend the first meeting. <br />Ordinance 84-125: Assistant Law Director Dubelko will explain at the <br />next meeting. <br />VI. NEW BUSINESS: <br />Elections will be held at the next meeting.
