PLANNING COMMISSION JANUARY 8, 1985 PAGE 4 <br />designated as a permitted use in the Mixed Use District, however, under <br />the context of Section 1202, Planning Commission has some latitude as <br />to the utilization of property as long as it is an appropriate use. <br />Assistant Law Director Dubelko noted that a hotel had been approved <br />in the Mixed Use District previously, however the Law Department would <br />like to research this further. In response to Mr. Gorris's question, <br />Mr. Dubelko believed that if proposal were changed for any reason re- <br />visions must return to the Planning Commission, however, he will also <br />look into this further. Adjacent property owners on Kennedy Ridge Road, <br />a representative and a resident of Victoria Plaza, and a representatiye <br />of the South East Area Growth Association had many objections to pro- <br />posal: fear that Kennedy Ridge might be used to relieve traffic con- <br />gestion in the area (traffic is at saturation point at present); motel <br />would be used by truck drivers and diesel motors would cause fumes; <br />motel is encroaching into a residential area (could be built further <br />east) and will affect residential status of entire area thus lowering <br />property values; type of motel is undesirable (less expensive version <br />of Holiday Inn); City will not benefit because it will attract un- <br />desirable penple and will increase cr.ime. Opponents would like traffic <br />study and study from Regional Planning Commission to determine if <br />proposal is appropriate to area. They also questioned if a 90' buffer <br />was not required between this area and the residential area. Mr. <br />G. Richland of Biskind Development Co. countered these objections: <br />motel will be located at eastern end of property, adjacent to inter- <br />change of 1480; Great Northern owns franchise and would not allow a <br />sleazy operation thus jeopardizing their shopping center• and corporate <br />center; Hampton Inns are the top of the moderate priced motel chains <br />($35.00 to $40.00 per room) rooms are comparable to higher price <br />motels without the amenities (swimming pool, restaurant, conference <br />rooms); Great Northern must abide by Hampton Inn contract; architec- <br />turally hotel will be residential in character; he doubts that truckers <br />would stop there, but they would not allow diesel motors to run for <br />hours; there are no plans to divert traffic down Kennedy Ridge Road; <br />they own property on Kennedy Ridge (zoned residential) but have no plans <br />to ask for any variances. Mr. Morgan advised that this is a Mixed Use <br />District and that under the code they would have the right to build <br />20 story high rise buildings; and also that they have the right to <br />develope their property. A motel could possibly be a less objectional <br />use of the land than the specifically permitted high rise buildings. <br />J. Burns moved to refer the Biskind preliminary development plans <br />to the Law for-the property located south of Country Club Blvd. and west of Great <br />Department Northern Blvd%/for determination of permitted use and to research the <br />90' set back that was questioned at this meeting and to report back at <br />the January 22nd meeting, seconded by E. Traczyk, and unanimously <br />approved. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />1) Charles L. Kovacic Assembly Plat, <br />Heard under Section III, Item 2. <br />Deerpath Subdivision No. 6, located north of I-480 and east of the <br />existing eastern end of Elm Road.
