? ,. <br />CITY OF NORTH OLMSTED <br />PLANNING COMMISSION <br />MINUTES - MAY 14, 1985 <br />I. ROLL CALL: <br />Chairman Gorris called the meeting to order at 8:00 p.ID. <br />Present: B. Gorris, T. Morgan, E. Traczyk, and J. Burns. <br />Absent: J. Brown and J. Wixted. <br />Also Present: Assistant Law Director J. Dubelko, Building Commissioner E. <br />Gundy, City Engineer J. Schaller, and Recording Secretary <br />B. Oring. (Councilman Wilamosky arrived later in meeting). <br />II. REVIEW AND CORRECTION OF MINUTES: <br />T. Morgan moved to approve the minutes of April 23, 1985, as presented, <br />seconded by E. Traczyk, and unanimously approved. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1) Ernest Nemeth, approximately 29328 Lorain Road. <br />Proposal to construct a strip shopping center. <br />No representative present. Proposal will be withdrawn. An adjacent <br />resident was advised that notices will be sent again when proposal re- <br />turns to the Commission. <br />2) Canterbury Tennis Academy, 5870 Canterbury Rd. <br />Proposal to construct tennis school <br />(Heard bv the Board of Zoning Appeals on April 3, 1985) <br />Mr. I. Waterbury presented plans for the tennis academy which reflect <br />the conditions of the variance granted by the Board of Zoning Appeals <br />on April 3rd. The basement of the existing'home will be converted to <br />locker rooms, etc (upper level will remain a residence) and two un- <br />lighted courts will be 'constructed on the adjacent vacant lot. Drain- <br />age is planned. The Board of Zoning Appeals had granted the variance <br />based on a country club (non-profit) in a residential area. Mr. Gorris <br />questioned if this will be set up under Section 501 of the Federal <br />Statutes as a non-profit organization. Papers have been filed with <br />the State. Assistant Law Director Dubelko stated that the City will <br />require a receipt from the Secretary of State for the incorporation <br />and a stamped copy of the articles of incorporation. If they should <br />ever start operating a business for profit, the occupancy permit would <br />be revoked. The Commission questioned how a tennis school could be <br />granted a variance for a country club. Mr. Dubelko read section 1125.16 <br />defin3ng a country club: "property operated not for profit but for the <br />benefit of a defined membership offering facilities for outdoor recrea- <br />tion including, but not limited to golf, tennis, swimming and archery <br />and providing meals or entertainment only for members and their guests".
