PLANNING COMMISSION JULY 23, 1985 PAGE 3 <br />5) Pizza Hut, 27845 Lorain Road <br />Proposal to construct addition to the rear for refrigeration and storage. <br />Heard by the Architectural Board of Review July 17, 1985. <br />The Architectural Board had approved with the stipulation that if any <br />mechanical units were added that they would have to be screened. It was <br />pointed out that the existing units were not screened. The Commission <br />would like these units screened as well: Assistant Law Director Dubelko <br />advised that the Commission could request that the existing units be <br />screened as a stipulation of this approval. -J. Brown moved to approve <br />the proposal of the Pizza Hut to construct an addition to the rear of <br />their restaurant for refrigeration and storage with the recommendations <br />of the Architectural Board of Review at their meeting of July 17th and <br />that we recommend that they screen all existing mechanicals on the present <br />roof, seconded by J. Wixted. Roll call on motion: Brown, Wixted, Gorris, <br />Burns, Yes. Mr. Morgan, No. Mr. Morgan explained that he would like - <br />the screening to be a condition for approval. T. Morgan moved to re- <br />consider the last motion, seconded by B. Gorris, and unanimously approved. <br />T. Morgan moved that the proposal to construct an addition to.the rear <br />for refrigeration and storage for the Pizza Hut be approved on the condi- <br />tion that the present mechanical units be screened, seconded by B. Gorris, <br />and unani.mously approved. . <br />6) Halleen Chevrolet, Inc., located on the south side of Lorain Road west <br />of 27845 Lorain Rd. (Pizza Hut) <br />Proposal to construct a truck dealership. Heard by the Architectural Board of Review July 17, 1985. <br />Assistant Law Director Dubelko explained that the noise ordinance (Ord. <br />77-126, codified in chapter 555) does address the testing and repairs of <br />various'motor vehicles and prohibits noise disturbances to cross residen- <br />tial boundries and also prohibits using loud speakers from 8 or 9 p.m. <br />until the following morning. Simple violations are minor misdemeanors, <br />knowning violations are misdemeanors of the fourth degree and could con- <br />ceivably result in a jail sentence. He also stated that Planning Com- <br />mission could have some discretion as to requiring solid fencing to <br />screen the west property (residential use in a General Retail Business <br />Area) but the ordinances are not as clear as they are pertaining to <br />screening residentially zoned property. Plan shows solid fence abutting <br />residential property but chain link on the west property line. Lighting <br />and location of speakers are shown on plan. Mr. Geiser, attorney, ex- <br />plained that new paging system was being installed at present location and <br />will be installed at this location. Under this system the paging would <br />first be directed to the inside of the builing and only directed outside <br />if page was not answered inside, music would not be played outside at all. <br />If no easement for drainage into the creek is procured, they will pumP <br />storm water into storm sewers on Lorain Road. The Engineering Depart- <br />ment has reviewed both plans. Neighbors viewed the plans and had objec- <br />tions regarding the paging.system, retention, fencing and landscaping, <br />and lighting. Regarding the paging system,they stated that they can <br />hear paging from across the street now, and even with the new system, even <br />one or two calls are too many. Mr. Geiser, attorney for Mr. Halleen, <br />stated that after the new system is installed at the present location, they <br />will request the Police Department to moniter the system with their audio
