ROLL CALL: <br />Chairman Burns called the meeting to order at 8:00 p.m. <br />Present: B. Gorris, T. Morgan, E. Traczyk, J. Brown, and J. Burns. <br />J. Wixted <br />Also Present: Assistant Law Director-J. Dubelko, Building Commissioner <br />E. Gundy, City Engineer J. Schaller, Councilman R. Bierman, <br />and Recording Secretary B. Oring. <br />TI. REVIEW AND CORRECTION OF MINUTES: <br />T. Morgan moved to approve the Minutes of September 10, 1985 as submitted, <br />seconded.by:.E..Traczyk,.and unanimously.approved. <br />III. ' ' BUILDING,DEPARTTiENT, REQUESTS : ?-. , <br />Chairman Burns.announced that items 6, 7, and 8 have been withdrawn by <br />the developers and would not be-heard tonight. <br />1) Hennie Homes, located west of 25200 Lorain Road. <br />Proposal to construct retail building. <br />(Continued from Planning Commission September 10, 1985) <br />City Engineer Schaller presented county survey taken in July of 1982 <br />from 7:00 a.m. to 6:45 p.m, show that 22,441 vehicles went through <br />the intersection of Lorain Road and Great Northern Blvd; 2482 vehicles <br />turn left from Lorain Road (west bound) south onto Great Northern. <br />No projected figures are available taking into consideration the <br />opening of relocated S.R.252 south. He also gave the members copies <br />of accident reports since 1984. City Engineer Schaller advised that <br />he was told by the Design Department of the Ohio Department of Trans- <br />portation, that at time of the purchase of the right of-way, a tem- <br />porary easement was purchased for use during the construction; that <br />easement would extend almost to the building. They also stated that <br />the Lorain Road cuzb cut would not be acceptable after the road was <br />put in (this has been considered temporary)Pand that the building <br />would have to be set to the grade of the proposed road. Mr. Schaller <br />will get this information in writing. Mr. Manning, attorney for Mr. <br />Puzzitiello, stated that the developer would agree to close the Lorain <br />Road driveway. Assistant Law Director Dubelko advised that the Com- <br />-mission cannot. deny approval on basis of traffic. He went on to say <br />that Section 1174.03 requires a set back of twenty five feet from a <br />side street, but cannot reduce the buildable area to less than twenty- <br />five feet. The Law Department does not believe that relocated S.R.252 <br />could be considered a side street (which implies a municipal street); <br />it is the intex'preta.tion of the Law'Dept,that a-building at this loca- <br />tion would require a 50' set back on both Lorain Road and 252. Mr. <br />Manning stated that this would make this property virtually unbuild- <br />- able, since it would leave only 25' on which to construct a building
