J. <br />Burns moved to refer the Vicko Rathburn subdivision to the Law Depart- <br />ment for its consideration of the reporting requirements to O.D.O.T. <br />regarding centerline requirementsand sub.divisinn line movements to deter- <br />mine those requirements, seconded by J. Wixted, and unanimously approved. <br />2) C. & C. Realty Co. Assembly Plat, location is the south side of <br />Lorain Road between MacKenzie and Decker Roads. <br />Proposal is to combine parcels 235-7-9 and 235-7-10 into one (1) parcel. <br />Mr. Halleen explained that he is assembling the lot for the purpose of <br />constructing a dealership for the sale of light truckse Width of lot <br />will be 147' (150' required in the General Retail Business area)o Assis- <br />tant Law Director Dubelko explained that no variance is required since <br />two lawfully non-conforming lots are being combined to make one lot which <br />is less non-conforming. Neighbors questioned why variance was granted <br />to display cars in front set back when lots were not combined. Mr. <br />Dubelko advised that when the variance was granted it was assumed that <br />lots would be assembled (application and plans would show both lots as <br />one) and building plans would not be approved until assembly plat was <br />submitted. Councilman Wilamosky stated that the study of drainage is <br />required according to the Section of the code on minor subdivisions. Mr. <br />Dubelko stated that this is an assembly, not a subdivision and ordinance <br />is primarily concerned with the sudivision of property for the construc- <br />tion of homese Commission is not reviewing the building proposal at <br />this time, only the assembling of the two parcels; drainage will be-re- <br />viewed with building proposal. Neighbors have many concerns, lighting, <br />drainage, and most especially the noise level (they can hear the speakers <br />from the Halleen car lot across Lorain Road,now).; this will be adjacent <br />to their homes. They questioned if property could be drained to ditch <br />in the rear since it would appear that ditch is totally on their resi- <br />dential property and may not be within the existing easement, and also <br />with all this paved surface draining into their ditch, it would con- <br />stantly be full of water and would be a hazzard. Engineering will re- <br />view these problems when.building proposal is_heard. Mr. Halleen is <br />not planning to do repair work at this location at this time; but s"tated <br />that he is negotiating-for adjacent property. Planning Commission has <br />no valid reasori for denying.tfie assembly of this property and neighbors <br />were advised they would be notified when building proposal comes before <br />them. J. Burns moved to approve the C. and C. Realty Co. Assembly Plat, <br />location is the south side of Lorain Road between MacKenzie and Decker <br />Roads, seconded by T.
