. Y <br />i <br />BOARD OF ZONING APPEALS JULY 5, 1984 PAGE 4 <br />Chairman Remmel called all interested parties before.the Board. The oath <br />was administered to Mr. Golden and Mr. Boehnlein, a neighbor. Mr. Golden <br />stated that he would like to put a pool in next year, but existing fence <br />needs to be replaced. Adjacent neighbor has a pool and a 6' fence on one <br />side of his property and there is a creek at rear of property which he <br />would like to fence off. Mr. Boehnlein has no objections. Board is re- <br />luctant to grant a variance on the promiseof a swimming pool. C. Remmel <br />moved to grant a 1' height variance, seconded by R. Bugala. Roll call <br />on motion: Remmel, Bugala, Graves, Helon, and Horvath, Nay. Motion <br />failed to pass. Variance denied. <br />12. Hoops 'N' Hollers Quilt shop (S. & R. Luther), 4352 Columbia Rd. <br />Request for variance (1133.13). Request variance to operate craft shop <br />in Residential District. Violation of Ord. 62-33, Section 1151.01. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. and Mrs. Luther, owners, and neighbors. Mr. <br />Luther explained this would be for a craft shop which is a low profile, <br />quiet business with approximately 15 to 25 cars dailey. Exterior of <br />structure will not be altered. Parking for 10 cars will be added. Pro- <br />perty is surrounded on three sides by commercial buildings and on one <br />side by residential. He believes that this would be a good buffer zone <br />between residential and commercial areas. Mrs. Matowitz objects on the <br />basis that there is too much commercial property in the area and too <br />much traffic congestion; neighbors cannot get in and out of driveways. <br />Law Director Gareau stated that this is a rezoning request, and he doesn't <br />feel that the Board can grant such a variance. He reminded the Board <br />tnat there is litagation pending regarding the denial of rezoning on the <br />property across the street. Chairman Remmel stated that this should go <br />to Planning Commission for a rezoning request. Mrs. Siebert presented a <br />petition from almost 100 people opposing the variance. C. Remmel moved to <br />grant the variance, seconded by E. Graves. Roll call on motion: Remmel, <br />Graves, Bugala, Helon, and Horvath, Nay. Motion failed to pass. Variance <br />denied. <br />13. John Keifer, 3865 Canterbury Rd. <br />Request for special permit to add to non-conforming dwelling (front set <br />back). Special permission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Keifer. L. Horvath moved to grant the special <br />permit, seconded by E. Graves, and unanimously approved. Special permit <br />granted. <br />Donald and Sandra Johnson, 3144 Clague Rd. <br />Request for variance (.1133.13). Request 1' variance for fence and vari- <br />ance for solid fence.(not 90% open) on corner lot. Violation of Ord. <br />62-33, Section 1151.04 H. <br />Case continued from meeting of June 6, 1984. Appelant wishes to continue <br />until March or April Of 1985. Board discussed continuance and agreed that <br />this would be too long a time to continue. It was noted that appelant can <br />resubmit at a later time. R. Bugala moved to continue the D. & S. Johnson
