BOARD OF ZONING APPEALS JUNE 6, 1984 PAGE 2 <br />4. William J. Kappa, 5669 Whitehaven <br />Request special permit to add covered deck to non-conforming dwelling (front <br />set back). Special permission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Kappa and neighbor, Mrs. Wolfe who stated that <br />she believed that the deck was an improvement. Regarding variance granted <br />May 2, 1984, with condition that his two lots be assembled, Mr. Kappa ex- <br />plained that he could assembly property by having two permanent parcel <br />numbers combined into one through the Cleveland Title Company;thus he would <br />never be able to se11 lots separately. This is less expensive than assem- <br />bling through the City which would require a survey. Mr. Kappa said Assis- <br />tant City Engineer McDermott has no problem with this if the Board is in <br />fagreemerit. Law Director Gareau stated that this has been done in the past, <br />and since this is combining.the lots, there should be no problem, if he <br />?v were splitting the lot, it might create a problem. Mr. Bugala questioned <br />if this deck conforms to code. The deck is under construction, however, <br />the special permit is required only if a roof is constructed. Mr. Kappa <br />is planning a lattice type roof attached to rafters. Footers are 18.inch <br />concrete pilla"rs, only 1 foot deep. Building Commissioner Gundy stated <br />that these are not sufficient for the lattice roof, but there would be no <br />problem with just rafters. C. Remmel moved to grant the special permit for <br />the covered deck providing it meets the qualifications of the Building De- <br />partment, seconded liy R. Bugala, and unanimously approved. Mr. Kappa <br />again questioned'if.he could combine the permanent parcel numbers instead <br />of assembling the lot. Law Director Gareau suggested that the title com- <br />pany call him regarding this situation_. Special permit granted. <br />5. Wayne Elias, 27491 Linwood Circle <br />Request for variance (1133,13). Request 9' front set back variance for <br />garage additione Violation of Ord. 62-33, Section 1159.01. Also request <br />50 sq. ft. variance for area of garage. Violation of Ord. 62-33, Section <br />? 1151.04C. <br />r <br />Chairman Remmel called a11 interested parties before the Board. The oath <br />? was administered to Mr. & Mrs. Elias and neighbors, J. Solt, W. Simko, J. <br />Disch, and D. Tischler. Neighbors are concerned that front addition will <br />not conform to neighborhood; will•set a precedent; will require too much <br />concrete; will block view of landscaping. Mrs. Elias advised that the <br />additional space will be a workshop, not a three car garage, and that ad- <br />ding to the rear would not be possible. Two statements were submitted in <br />favor of the variance, and a letter from Dr. Simko (now present) had pre- <br />viously been submitted, objecting to the variance. E. Graves moved to <br />grant the varian.ce for Mr. Elias, seconded by R. Bugala. Roll call on <br />\motion: Graves, Bugala, Remmel, and Horvath, Nay. Motion failed'to pass. <br />IVariance denied.. <br />6. Kelly J.
