BOARD OF ZONI.NG APPEALS MAY 2, 1984 PAGE 3 <br />Sparky DiBenedetto, property located on the northside of Brookpark Ext. be- <br />tween the rear of 4789 Dover Center Rd. and the Gold Circle/Bryant Stratton <br />parking lot. <br />Request for variance (1133.13). Request variance for depth of lots (135' <br />required) to subdivide property in "A" Residential Area. Violation of Ord. <br />62-33, Section 1157.01-C. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. DiBenedetto who explained that request for property <br />to be rezoned to General Retail, Business has been denied, even though it <br />is his contention that property was supposed to have been rezoned may years <br />before. Mrs. E. Koepke, a neighbor, had submitted a letter stating that <br />she was in favor of the variance so that residential homes could be built. <br />Square footage and frontage of lots conform to code, only depth needs a <br />variance. R. Bugala moved to grant the variance for the depth of lots; <br />seconded by E. Graves, and unanimously sproved. Building Commissioner <br />Gundy suggested that if Board establisY-Wg a building line for both lots in <br />line with the side building line of the corner house which faces Dover Cen- <br />ter Road it would eliminate requesting another variance R. Bugala moved that <br />any residential structure that is constructed on these lots as approved <br />here tonight would have a front set back line consistant with the distance <br />between the side of the present structure on sublot #l and the right-of-way, <br />seconded by E. Graves, and unanimously approved. Variances granted. <br />8. Ponderosa Steak House, 25779 Lorain Rd. <br />Request for variance (1133013). Request 24 sq. ft. variance for addition <br />to pole sign. Violation of Ord. 62-33, Section 1221.06 (28 sq. ft. vari- <br />ance denied on September 7, 1983). <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Morgan of Ponderosa who explained that all illegal <br />signs have been removed, and that they need a changeable copy sign to ad- <br />vertise specials. It was suggested that size of existing pole sign be re- <br />duced so that sign with changeable copy would conform to square foot re- <br />quirement, or else a ground sign with changeable copy,which can be installed <br />without. a variance, be installed. R. Bugala moved to grant the 24 square <br />foot variance for an addition to pole sign, seconded by E. Graves. Roll <br />call on motion: Bugala, Graves, Horvath, and Remmel, Nay. Motion failed <br />to pass. Variance denied. <br />9. Francis A. Gardner, 4585 Porter Rd. <br />Request for variance (1133.13). Request 6°9" variance for distance between <br />addition and existing garage. Violation of Ord. 62-33, Section 1151.04-C. <br />Also request special permit to add to non-conforming dwelling (front -set <br />back). Special permission required Ord. 62-33, Section 1231.02. <br />Chair.man Remmel called all interested parties before the Board. The oath <br />was administered to Mr. and Mrs. Gardner and their son. Board has no <br />problems with variance. L. Iiorvath moved to grant the variance and special <br />permit, seconded by R. Bugala, and unanimously approved.
