BOARD OF ZONING APPEALS APRIL 4, 1984 PAGE 2 <br />3. Richard P. Kadar, 5870 Canterbury Rd. <br />Request for variance (1133.13). Request variance to operate a recreational <br />facility in a residential area. Violation of Ord. 62-33, Section 1173.02. <br />Chairman Remmel called all interested parties before the Board. The oathwas administered to Mr. Kadar, Mr. Yesberger of North Olmsted Golf Course, <br />Mr. Scheeff and Mr. Prest of Springvale Country Club, and Mrs. Chapek. <br />Mr. Kadar stated this will be an outdoor tennis school and will be open for <br />7 months a year. Courts will be enclosed with a 10' screened fence and <br />landscaping. Pro shop and restrooms will be contained on the lower level <br />of the existing split level house. Courts will not be lighted or covered <br />and are adjacent to golf course parking lot. Eight parking spaces are <br />planned. There is concern by the Board and the adjacent golf course owners <br />that parking would be a problem. More spaces could be included if driveway <br />to house is widened. Letter from Springvale_Country Club stating possible <br />problems was submitted. Mrs. Chapek is representing Mr. Chovan who owns <br />adjacent propery. He was unaware that proposal was for commercial recre- <br />ation. He would definitely object to property being lighted at night. <br />Board questioned that this should not be a variance but should be rezoned. <br />Law Director Gareau stated that there is no recreational zoning as such, <br />and if property would be rezoned to general retail it would be able to be <br />used for any permitted use in the General :'Re t a il D i s t r i c t. R. Bugala <br />moved to accept the Richard P. Kadar variance, seconded by E. Graves. Roll <br />call on motion: Bugala, Graves, Horvath, and Remmel, Nay. Motion failed <br />to pass. Variance denied. <br />4. R. & M. Gates, Sr., 4600 Georgette <br />Request special permit (corner lot set back) to add patio to non-conforming <br />garage. Special permission required Ord. 62-33, Section 1231.02. <br />? <br />% <br />/Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mre Gates. Patio will be covered but will not be en- <br />closed. C. Remmel moved to grant the special permit, seconded by L. Horvath, <br />and unanimously approved. Special permit granted. <br />5. John Talan, Property west of 31376 Lorain Rd. <br />Request for variance (1133.13). Request 7.5' variance for total side lines <br />for, machine shop in Limited Industrial Area. Violation of Ord. 62-33, <br />Section 1173.02. , . <br />Chairman Remmel called all interested parties before the Board. The oath <br />/was administered to Mr. Talan and Mr. & Mrs. Halprin, the adjacent neighbors. <br />j,. Code calls for a total of 40' sideyards in Limited Industrial Area. Proposal <br />was explained to neighbors. Mr. Talan explained that he would not remove <br />any more foliage than necessary and that landscaping will be installed be- <br />tween his property and the Halprin's. He stated that he could build further <br />back without a variance, however cost would be prohibitive, especially since <br />grade is lower and would necessitate using pumps for sewers. E. Graves <br />moved to grant the variance for Mr. Talan for 7z feet for total sidelines <br />as-requested with the stipulation that he provide screening with appropri- <br />ate landscaping and shrubbery on the east side of the property, seconded <br />by R. Bugala, and unariimously approved. Variance granted. <br />6. Patrick Kilbane, Permanent parcels 231-19-040 and 041 Columbia Rd. (property <br />south of 3641).
