1 ? <br />BOARD OF ZONING APPEAL MARCH 7, 1984- PAGE 3 <br />Mr. Boss be requested to appear at the next meeting. Board would like pic- <br />tures of the surrounding area, and more details on the plan; total height, <br />accurate measurements, entrance, new driveway, etc. R. Bugala moved to <br />continue the G. Morrow request, seconded by E. Graves, and unanimously <br />approved. Case continued. <br />7. Michael Galati, 27539 Lorain Rd. <br />Request special permit to use non-conforming building (set back). Special <br />permission required Ord. 62-33, Section 1231.03 C. <br />Chairman Remnel called all interested parties before the Board. The oath <br />was administered to Mr. Galati and his attorney, Mr. Blackburn, who ex- <br />plained that he is going to refurbish the former gas station for auto re- <br />pair only and bring it up to code. At his request the Building Department <br />has given him a list of violations which must be corrected. Code violations <br />will be corrected, parking lot will be resurfaced, building will be painted. <br />Gas tanks have been removed, and no gas will be sold. Chairman Remmel has <br />several concerns: storing cars on property, lack of screen from residential <br />area and on the east property line, and he would like proposal to go to the <br />Architectural Board of Review. Law Director Gareau suggested that use be <br />permitted dependent on refurbishing the building and refer proposal to Plan- <br />ning Commission who could then refer to the Architectural Board. C. Remmel <br />moved to grant a special permit to use a non-conforming building to Michael <br />Galati but reYCovations plans must be referred to Planning Conimission and.must <br />comply to their requirements, seconded by R. Bugala, and unanimously approved. <br />Special permit granted. <br />8. Columbia Point Deli, 5600 Columbia Rd. <br />Request special permit to add to non-conforming.use consisting of cutting <br />through existing wall for a walk-up window. Special permission required <br />Ord. 62-33, Section 1231.02 (B-1). <br />.Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Jenner, the contractor, and the owner. Mr. Jenner <br />explained that he would be removing an existing window to put in a sliding <br />window for a pass through. This is for walk up traffic for the purpose of <br />' selling ice cream and seasonal items. Board was concerned about lack of <br />parking for customers and that this could be a dangerous situation. Total <br />parking is for approximately 22 cars. R. Bugala moved to approve the special <br />permit to add to con-conforming use, seconded by C. Remmel. Roll call on <br />motion: Bugala, Remmel, and Horvath, Nay. Graves, Aye. Motion failed to <br />pass. Special permit denied:.. <br />9. Hennie Homes, 28867 Lorain Rd. (Added.to Agenda). <br />Request relief from 8" storm:-.sewer connection as stated in Section 100.10 B2. <br />and request to use 6" connections as previously required. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Andreano, Engineer. It was explained that this re-, <br />quirement was included in the Zoning Codes. Law pirector Gareau advised <br />that this requirement is part of the Major and Minor Subdivision Ordinance <br />and should not be part of the Zoning Codes and this Board has no authority <br />to grant a variance for it. It would appear that an error was made since <br />the original ordinance required a 6" connection. The Engineering Department
