BOARD OF ZONING APPEALS FEBRUARY 1, 1984 . PAGE 2
1133.07.and that a request for a speeial ruling would be covered under
Section 1133.11 and would be used to determine whether a use in a specific
district would be considered a permitted use. These have been confused in
the past. He also stated that the Great Northern case was really not pro-
perly before the Board because they were not adversly affected by a ruling
of the Building Commissioner.
Chairman Remmel read a letter from Building Commissioner Gundy regarding
the Hart case heard January 4, 1984, advising that on January 12, 1984 the
Engineering Department measured the rear yard and that the variance granted
was adequate for the structure in the rear yard set back.
A letter from the Interim City Engineer, Robert Falardeau, to Planning
Commission (with a copy to this Board) requesting relief from the require-
ment of using 8 inch house connedtion as contained in Section 1000.10 (B)
(2). This is not a matter for this Board. Mr. Gareau advised that there
are provisions in the Platting and Engineering Codes to cover such a situa-
tion.
Chairman Remmel mentioned that when applicants for the Board are being con-
sidered, there should be a requirement that they be homeowners and tax
payers in the City. Mr. Gareau said that, by charter, this could not be a
condition, only that the members be residents of the City. Mr. Remmel
believes that prospective members should be made aware that all members
make a site inspection of each case and that there is no reimbursement for
gas.
Meeting was adjourned at 7:50 p.m.
, ?.;.
Ott
C. Remiuel, Chairman
B. Oring, R
rding Secretary
