Ext. <br />Proposal to enclose area with fence <br />(Continued from Planning Commission March 13, 1984) <br />Building Commissioner Gundy stated that parking would conform to code <br />as he had calculated it with the inclusion of 22 spaces which will be <br />added after existing fenced-in area is removed. Mr. Petitti, the <br />owner, and Mx. Santarelli, attorney, presented photographs of structure <br />(cashier.'s booth) which will be located in the enclosure and explained <br />that electricity will be brought in on a mast for overhead service. <br />The 30,000 sq. ft. area will be reduced to 10,000 sq. ft. after season <br />is over and the booth, extra fencing, and poles will be stored there. <br />Mr. Bugala, of Leenders Lane, questionedi'f installation of this kind <br />was proper under the code and if a leased area outside the store was <br />legal, and what reponsibilities of the lessee would be. He believes <br />that since part of the structure will remain all year, this should be <br />considered a permanent business and should meet all code requirements, <br />even if it would mean subdividing the property. Proposal does conform <br />fo code and other businesses have similar structures, for instance, <br />Fotomate. Mr. Bugala objected to proposal on basis that the same <br />operation at the Gold Circle store on Memphis Ave. is unsightly (pal- <br />lets, part of old building, lumber, etc. are all stored outside of <br />fenced area); and there is a structure (covered with plastic) on the <br />property which is partially dismantled, and another greenhouse type <br />structure which has been recently installed. Mr. Petitti stated <br />that the dismantled building was experimental and has been sold and is <br />in the process of being taken away and that no greenhouse building <br />was planned for North Olmsted. Assistant Law Director Dubelko advised <br />the Planning Commission is not to consider whether the business is <br />leased or not; they need only to consider if this is a proper use <br />under the code, and to determine if the building conforms to code. <br />Building Commissioner Gundy stated that the building would be consid- <br />ered as permanent and would conform to code. Mr. Bugala complained <br />that Petitti's had had a Christmas tree operation on North Olmsted's <br />Gold Circle lot and that the pallets are still in the parking and <br />landscape areas. Mr. Morgan agreed that this could become a problem. <br />Mr. Petitti stated that he has an agreement with Gold Circle to main- <br />his portion of the property and requested that the Commission check <br />with other communities where he is operating in conjunction with <br />Gold Circle to determine if there have been problems. Assistant Law <br />Director Dubelko stated that if materials were left after Petitti <br />was no longer occupying the.space, he would still be responsible for <br />clearing the area. Mr. Bugala question if storing fencing and the <br />cashier's booth in a fenced in area would be legal. Commission is <br />concerned that materials might be displayed outside the area and.that <br />other items could possibly be stored in the permanent enclosure. <br />Mr. Petitti agreed that all display material would be?contained with- <br />in the f ence and that at the end of the season he would call the <br />Building Dept. for an inspection before leaving the premises. No <br />signage is planned. T. Morgan moved that, in as much as_the proposal <br />to enclose a fenced area for a garden center on the Gold Circle pro- <br />perty is a proper use under the codes, that it be approved with the <br />following stipulations: that the building meets the code under the
