ROLL CALL: <br />Chairman Morgan called the meeting to order at 8:00 p.m. <br />Present: J. Burns, B. Gorris, E. Traczyk, J. tdixted, J. Brown and <br />T. Morgan. <br />Also.Present: Building Commissioner E. Gundy, City Engineer J. Schaller, <br />Assistant Law Director J. Dubelko, and Recording Secretary <br />B. Oring. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />B. Gorris moved to approye the Minutes of November 27, 1984 as submitted, <br />seconcled by J. Wixted, and unanimously?approved. III. BUILDING DEPARTMENT REQUESTS: <br /> <br />1) Amber Oaks Subdivision, Woodside Dr. and Deepwoods Way. <br />Proposal to install two signs in public right-of-way on Woodside Dr. <br />near intersection of Walter Rd. and near intersection of Gessner Rd. <br />(Continued from meeting of November.27, 1984). <br />Assistant Law Director Dubelko stated..that Law Department has concerns, <br />especially since there is no organized or incorporated group to main- <br />tain.the sign.. City is sufficiently.insured but there is a potential <br />liability in case-of injury since signs will be in public.right=of-way. <br />They-suggest that sign:near Walter:Rd. be placed directly on block "A" <br />if Shore West, who presumably ownes-it, would give.them license. -The <br />Police Department report also stated concern over proposed location off <br />Walter Road; since it migfit interfere with visibility. Chairman Morgan - <br />stated that the Planning Commission.has approved signs in the right-of- <br />way before, howeveT, he would like Council to.be aware of the Law Depart- <br />ment's.concern and the Safety Department's recommendations. He agrees <br />that the Walter Road sign should be placed on_'block "A'.';'Gessner Road <br />sign would have to be placed in public right-of-way. It was Mr. Dubelko's <br />opinion that_if sign is placed-on-?Shore West property, maintenanee-would <br />still be the responsibility of the person who installed it. T. Morgan <br />moved that the Amber Oaks proposal to`install two signs in the public <br />riglit-o£-way be basically approved, w.ith the following comments: that <br />the sign on the public right-of-way on Woodside Dr. near Gessner be al- <br />lowed to be installed as it stands; that the sign that is shown"on the <br />north east coxnex.of Woodside and Walter Rd. be instalTed on block "A" <br />which is currently a piece of land owned by Shore West Construction, <br />suliject to!the recommendations or the warnings of the Law Department <br />relative to the potential public liability in this area, and to forward <br />a this onto Council with the recommendations of the Law Department and <br />- to also include the recommendations of the Safety Department report, <br />seconded by B.
