<br />BOARD OF ZONING APPEALS AUGUST 3, 1983 PAGE 4 <br />there is approximately a 50' grass buffer on both sides of Brookpark. After . <br />the addition there would be a 15' set back along Brookpark Road. Mr. <br />Bugala stated that it should be taken into consideration that the limited <br />access restriction may be taken off Brookpark. Addition cannot be built to <br />rear without moving all mechanical equipment in the rear of building, and <br />the store would also have to be closed from 3 to 6 months if this were done. <br />Mr. Richland objected on the basis that this addition would obscure view to <br />Great Northern's adjacent vacant property. Mr. Remmel stated that all <br />properties along Brookpark Road would want to encroach into the set back <br />areas. Law Director Gareau stated that the Board is just deciding on this <br />one parcel, and that it is unique since it has frontage on both streets. <br />Addition cannot be added to front because the owners of the shopping center <br />will not agree to it. C. Remmel moved to grant the variance, seconded by <br />R. Bugala. Roll call on motion: Remmel, Bugala, and Graves, Nay. Horvath, <br />Aye. Motion failed to pass. Variance denied. -- Mr. Drager asked the <br />Board for a ruling if there is such a thing as two front yards. Mr. Gundy <br />stated that a through lot is a lot with frontage on two streets, the code <br />does not specify that there has to be access onto both streets. Mr. Draeger <br />stated that if this were a regular lot with frontage on Lorain Rd. only, <br />and the Brookpark frontage were considered a rear yard, they could reduce <br />their addition and conform to rear yard requirements in a general retail <br />area. Mr. Drager still maintained,that a through lot would seem to mean <br />that you can go from one street to another. Mr. Gundy stated that this <br />is not specified in the code. Mr. Rini stated that they would like to up- <br />date their 22 year old store. It was repeated that they can add on to the <br />front or the back as far as the City is concerned. <br />9. John & Ruth Ginley, 23045 Mastick Rd. <br />Request special permit to add to non-conforming dwelling. Special per- <br />mission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The oath <br />e <br />was administered to Mre & Mrs. Ginley. E. Graves moved to grant the special <br />permit, seconded by R. Bugala, and unanimously approved. Special permit <br />granted. <br />10. Raymond H. Rrecic, 4823 Grace <br />Request for variance (1133.13). Request 13'6" variance for distance be- <br />tween addition and existing garage. Violation of Ord. 62-33, Section 1151.04C. <br />Also request special permit to add to non-conforming dwelling (front set <br />back is 48'4"). Special permission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Krecic. It was pointed out that the neighbor <br />has them same type of addition and this will be an improvement to the house. <br />E. Graves moved to grant the variance and special permit, seconded by L. <br />Horvath, and unanimously approved. Variance and special permit granted. <br />11. Victor Cenzoria, 24745 Florence Ave. <br />Request for variance (1133.13). Request 2' side yard variance and 7' total <br />side yard variance for 2' garage addition. Violation of Ord. 62-33, Sectio.n
