BOARD OF ZONING APPEALS AUGUST 3, 1983 PAGE 3
Mr. Peterson. Mrs. Schneider stated she did not like chain link
fences and she wanted to contain her dog. She stated that there
are several solid fences on corner lots. She is planning on a
board on board fence 4' high. Mr. Graves suggested a split rail
fence with wire between the rails. It was determined that some of
her fence was to be in front set back and could only be 30" high;
Mrs. Schneider stated that because of the wheel chair ramp she
must have the fence start at the front building line. The Board
will agree to that. E. Graves moved to grant a variance to start
the 4' fence at the front building line of the house, but fence
must be 3' from sidewalk and 90% open, seconded by R. Bugala, and
unanimously approved. Partial variance granted.
6. Robert J. Holzheimer, 24319 So. Oxford Oval
Request for variance (1133.13). Request 11' rear yard variance for
patio awning. Violation of Ord. 62-33, Section 1163.01. Also re-
quest special permit to add to non-conforming dwellinge Special
permission required Ord. 62-33, Section 1231.02.
Chairman Remmel called all interested parties before the Board. The
oath was administered to Mr. Holzheimer. This is only for an awning.
R. Bugala moved to grant the special permit and variance for an awn-
ing only, seconded by E. Graves, and unanimously approved.
7. Alfred J. Rolle, 3362 Walter Rd.
Request for variance (1133.13). Request 18 sq. ft. variance for
garage (pole type). Violation of Ord. 62-33, Section 1151.04C.
Chairman Remmel called all interested-parties before the Board. The
oath was administered to Mr. Rolle and his son. Existing garage will
be removed. This is a pole.type garage and siding and shingles will
match the house. There will be a gravel floor. Code does not re-
quire a concrete floor in a detached garage. This is a standard
size (32' x 24') metal building and 18 sq. ft. over code. Building
conforms to building codes. Mr. Rolle stated that the peak of the
gable will run north and southe R. Bugala moved to grant the var-
iance based on existing building codes but the gable must run north
to south, seconded by E. Graves, and unanimously approved. Variance
granted.
8. Rini's Supermarkets, Inc., 26035 Lorain Rd.
Request for variance (1133.13). Request 35' front set back variance
for addition. (Property fronts both on Lorain and Brookpark Roads -
considered a through lot). Violation of Ord. 62-33, Section 1174.02.
Chairman Remmel called all interested parties before the Board. The
oath was administered to G. Draeger, Architect, C. Rini, and G. Richland
from Great Northern Partnership. Mro Draeger explained that even
though the property has frontage on both roads, Brookpark Rd is
lisnited access and there is no access off Brookpark. Brookpark has
a 160' right of way and addition will be constructed on that side;
