.- <br />BOARD OF ZONING APPEALS MAY 4, 1983 <br />PAGE 2 <br />5. Paddock Fishley Greenhouses, Inc., 25132 Kennedy Ridge Rd. <br />Request special permit. Request special permit to add greenhouses to <br />non-conforming business (in residential area). Special permi.ssion re- <br />quired Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered to Roger and Donald Paddock and several neighbors. <br />It was clarified that this land is owned by the State of Ohio and they <br />are intending to buy it when it is up for bid, and if they obtain the <br />special permit. The greenhouses have been there for about 55 years. <br />Mrs. Gaskowskitz of Sunset Oval stated many complaints: addition put <br />on without neighbors being notified, chimney not high enough and coal <br />causes black smoke which gets into homes, piles of dirt always in back <br />of property, weeds not cut, rubbish on property, water which runs off <br />on to adjacent property, grade of land is being raised, buildingsneed <br />painting, stones and coal scattered onto neighborhood lawns from trucks <br />which drive along property line, noisey chickens on property (actually <br />fighting cocks),and junk vehicles on property. Mr. Paddock stated that <br />water is drained into sewer which runs into Sunset Oval, and that the <br />cocks andjunk vehicles belong to an employee and he will get rid of them. <br />Many other neighbors made same complaints and also stated that rats have <br />been seen, mosquitoes should be sprayed, and firecrackers are heard from <br />there late at night. It was the consensus of the neighbors that before <br />an addition is put on the owners should take care of the property that <br />they have. Mr. Paddock agreed to change over and use an existing higher <br />chimeny which would eliminate the dirt, he will get rid of the junk <br />vehicles and fighting cocks, and will improve the property. The case <br />will be continued until these unsightly conditions are eliminated. <br />Mr. Paddock stated that he would clean up the property within 30 days, <br />but he cannot change over to the other chimney within that time. Request 5' total side yard variance to <br />construct dwelling. Violation'of Ord. 62-33, Section 1161.01. <br />6. Owen McGuiness,.vacant land, permanent parcel ninnber 233-22-045, Wel- <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered to Mr. McGuiness and surrounding property owriers. <br />It was explained that there are 3 adjacent vacant lots, all 50' wide. <br />' Naighbors did not object to the variance. Mr. Remmel stated that a house <br />r? could be built on a 50' lot without a variance, especially since the lots <br />are deep. It was pointed out to the other owners that if this property <br />gets a variance, it does not necessarily follow that the other two lots <br />will be granted variances. C. Remmel moved to grant the variance, se- <br />conded by T. Restifo. Roll call on motion: Remmel, Restifo, Bugala, <br />Graves, and Horvath, Nay. Motion failed to pass. Variance denied. <br />7. Rosemary J. French, 4571 Vernon Drive <br />Request for variance (1133.13). Request 2`6" variance for height of fence <br />(24' length) and not 50% open.
