x'
r
BOA.R.D OF ZONING APPEALS MAY 4, 1983 PAGE 3
questing 3 sections of 5' fence along her driveway in front set back. L.
r Horvath moved to grant the variance, seconded by T. Restifo, and unani-
mously approved. Variance granted.
8. John G. Ebert, Jr., 5668 Fitch Rdo
Request for variance (1133.13). Request 423 sq. ft. variance for garage
area. (425 sq. ft. on second floor of garage). (Existing attached garage
to be converted to family room). Violation of Ord. 62-33, Section 1151.04C
Chairman Remmel called all interested parties before the Board. The oath
` was administered to Mr. and Mrs. Ebert and a neighbor. It.was clarified
? that the variance_was for the second floor of the garage. The present
attached garage will be renovated into a family room. Building Commis-
sioner Gundy stated that he would like the Board to condition the vari-
ance on coriverting the present garage to a family room (take out garage
door, etc.). Neighbor objected to having 2 story garage. It was agreed
that if the exterior garage door is removed and window area is included
in existing garage, they could still use inside for storage until new
garage is built. Sheds on property will be removed. C. Remmel moved to
grant a variance for a one story, 748 sq. ft. detached.garage as shown
on sketch submitted on application, provided that first the existing at-
tached garage is converted to a family room, and that the sheds on the
property will be removed, subject to the Building Department's inspec-
tion before permit is issued for garage, seconded by R. Bugala, and unan-
imously approved. Variance granted.
9. Jerry R. Wood, 27981.Marquette Blvd.
Request for variance (1133.13). Request 15' rear yard variance for patio
enclosure. Violation of Ord. 62-33, Section 1163.02.
? Chairman Remmel called all interested.parties before.the Board. 2'he oath
was administered to Mr. Wood. Mr. Wood agreed that a 12°6" variance would
be sufficient. C. Remmel moved to grant a 12'6" variance, seconded by E.
Graves, and unanimously approved. Variance granted.
10. 7515 Comgany, 7515 Pearl Rd. Cleveland, OH, (s/1 23 Tara Lyn Dr. of Sub-
division #2).
Request for variance (1133.13). Request variance for depth of lot (one
property line less than 135'). Violation of Ord. 62-33, Section 1157.O1Ce
Also request 10' front set baclc variance. Violation of Ord. 62-33, Section
1159.01. Heard by Planning Commission 4/12/83.
Chairman Remmel called all interested parties before the Board. The oath
was administered to Mr. McKay and neighbor D. Winsink. It was explained that lot meets area requirements, and that it could meet depth require-
ments but this would leave an unbuildable lot. Mr. McKay stated that
they would like this variance as an alternative, however, if at all pos-
sible they will buy some property to the rear at a later date, and re-
subdivide at that time. Planning Commission had recommended that the
depth variance be granted. There is also a request for a front set back
variance, however the Board agrees that this could place the house to the
front of the adjacent property; if it is necessary to grant a front set-
back variance, the builder.should request it when he,has a specific plan
to present. R. Bugala moved to grant the variance for the depth of the
lot (not 135' deep), only, seconded by T. Restifo, and unanimously approved.
Variance granted.
