f <br />BOARD OF ZONING APPEALS <br />MAY 4, 1983 <br />PAGE 4 <br />11'. Leo Woodman, 25915 Kennedy Ridge Rd. Request special permit. Request special permit to add attached garage <br />to non-conforming dwelling (front set back). Special permission re- <br />quired Ord. 62-33, Section 1231.02. (Variance for detached garage de- <br />nied April 6, 1983). <br />Chairman Remmel called all interested parties before the Board..The oath <br />was administered to Ken Hess, Woodman's son-in-law. This garage will be <br />attached to the front of the existing garage. Board had suggested that <br />garage be attached to the side of the garage. This proposal could still <br />; place garage in front of any house which would be built on adjacent lot. <br />There is a problem with a lower grade to the side of the existing garage, <br />and will be more expensive to build.there. Board believes this will still <br />be out too far and.will not be in line with other houses in neighborhood <br />T. Restifo moved to grant the variance,.seconded by E. Graves. Roll call <br />on motion: Restifo, Graves, Remmel, Bugala, and Horvath, Nay. Motion <br />failed to pass. Variance denied. <br />12. Frank Bott III, 5646 Porter Rd. <br />Request for variance (1133.13)..Request 4' side yard variance and 4' rear <br />yard variance and 6' variance for distance between house and garage. Vio- <br />lation of Ord. 62-33, Section 1151.04C. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mrs. Bott and Mr. Scott, the contractor. It was <br />explained that they own the lot next door but the two lots are not as- <br />sembled and they cannot build a garage on a vacant lot. Mr. Remmel <br />stated that a 2 car garage was not suitable for this size lot and it <br />,i' would be difficult to get into thesecondspace. The second space could <br />be used.for storage, not for a car. Mrs. Bott will agree to 3' variances. <br />The Board is in agreement that this garage is too Iarge for the propertyo <br />T. Restifo moved to grant the variance, seconded by E. Graves. Roll call <br />on motion: Restifo, Graves, Remmel, Bugala, and Horvath, Nay. Motion <br />failed to pass. Variance denied. <br />13. Michael Shiels, 27351 Nantucket Dr. <br />Request for variance (1133.13). Request 5' total side yard variance for <br />. . <br />addition. Violation of Ord. 62-33, Section 1161.01. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. Shiels. This is a deep lot, and the 5' total side- <br />yard variance would be necessary for the fireplace and a 3' variance at <br />the corner of the addition. E. Graves moved to grant the variance for <br />5' for the fireplace, and 3' at the south corner of the addition, seconded <br />by L. Horvath, and unanimously approved. <br />14. Harry Mahan, 4721 Bailey Rd. <br />Request for variance (1133.13). Request 4' rear yard variance for addition. <br />J Violation of Ordo 62-33, Section 1163.01. <br />Chairman Remmel called all interested parties before the Board. The:oath <br />was administered to Mr. Mahan and his contractor, D..Reinhart. The Board <br />has no problem with the request. R. Bugala moved to grant the variance, <br />. seconded by L. Horvath, and unanimously approved. Variance granted.
