? <br />/ • ' Y <br />•. ^ PLANNING COMMISSION JUNE 14, 1983 PAGE 2 <br />(2) Romp Rezoning <br />Proposal is to rezone the southerly abutting portion to Danny <br />Boy's site (Columbia and Lorain) from the existing zone of <br />"C" Residence, Single, to Retail Business, General. <br />W. Giesser, attorney, represented the Romp Brothers. Property <br />facing Lorain and a portion facing Columbia is zoned General <br />Retail, Business; rear of property (fronting on Columbia Rd.) <br />is zoned "C" Residential. Proposal is to rezone this section to <br />General Retail so zoning follows lot line. West lot line is less <br />than 500' deep along Lorain Rd. (General Retail zone line arbi- <br />trarily was drawn 500' north and south parallel to Lorain Rd); <br />eastern lot line is more than 500'. No specific proposal is <br />being made at this time, other than to increase parking area. <br />and possibly include a small park. Adjacent_ neighbors objected; <br />1) proposal will increase traffic, 2) Ivorth Olmsted has an over <br />abundance of Commercial property, 3) property values would be <br />decreased, 4) existing parking conf orms to code (as stated when <br />addition was approved in 1982) and some new parking has been <br />added since, 5) after property is rezoned, any conforming structure <br />could be built (an office building had been approved by the City <br />but was never constructed). Mr. Giesser responded that plans for <br />the office building had definitely been abandoned and it would <br />not be built, that parking does conform to City Ordinances but <br />is inadequate for the amount of business, and that now when pro- <br />p2rty is rezoned, zoning lines must follow lot lines. Commission <br />was concerned that if this new zoning line were continued across <br />Columbia Rd., it would encompass several residential lots and <br />since other lots are zoned for separate uses and many commercial <br />areas on Lorain Rd. are not 500' deep, a precedent could be set. <br />There seems to be no justified need to rezone and once property is <br />rezoned City must approve any conforming use. Assistant Law Dir- <br />ector J. Dubelko stated that there was no legal need to rezone <br />property so that zoning conforms to lot lines. B. Gorris moved <br />to reject the proposed rezoning of Romp Brothers sublot #4 and <br />a portion of sublot #3 (the southerly portion of the property <br />which lies in the Residential Zone) and in so doing would like to <br />say that while we.sympathize with the zoning that they presently <br />have, we do not believe it is in the best interest of the City of <br />North Olmsted, seconded by J. Wixted, and unanimously approved. <br />Mr. Giesser requested that this proposal be forwarded to the <br />BZD Committee of Council. <br />V. COMMiTNICATIONS : <br />Report from Safety Department regarding to Country Club Blvd median <br />strip cut. Copies will be sent to each member. <br />VI. NELr' BLTSINESS : <br />Mr. Roberts stated that one-way exit oniy drive from Great Northern <br />Shoppi.ng Eenter is dangerous and possibly should be closed. A letter <br />will be drafted to the Great Northern Partnership. Mrs. Brown stated <br />that the outer drive has many blind spots and is also dangerous.
