<br />, <br />PLANNING COMMISSION NOVEMBER 10, 1983 PAGE 3 <br />VII. OLD BUSINESS: <br />There has been no response from the Board of Zoning Appeals to letter <br />regarding variances granted for platting of land. <br />Vice Chairman Burns has drafted two letters. He read letter to Chair- <br />man Woerpel, BZD Committee, requesting legislation prohibiting pole <br />signs with illuminated poles or at least including illuminated pole <br />in allowable sign area. Prior to the meeting Councilman Woerpel had <br />advised that he has requested such legislation. <br />Mr. Burns then read letter regarding variances granted by Board of Zon- <br />ing Appeals which, in effect, plat property. Since the Commission is <br />the platting authority of the City, by charter, the Commission does <br />not feel that they should be bound by such variances. They are also <br />requesting that actions of the Board of Zoning Appeals be appro.ved <br />by Council and noted in their minutes. Assistant Law Director Dubelko <br />advised that variances, by charter, are not reviewed by Council; only <br />special rulings as.stipulated in Zoning Ordinances can be reviewed by <br />Council if they so desire. Regarding of platting of land, there is a <br />legal opinion that the variance must be granted prior to being heard <br />by Planning Commission. Planning Commission then would have a proposal <br />with a variance which is binding on them. Mr. Burns will redraft <br />letter requesting an amendment to.40aTI-t-rn ordinance establishing a <br />procedure so that the Commission would look at platting proposals <br />first and then refer to the Board of Zoning Appeals for a variance. <br />Assistant City Engineer McDermott advised that Al Schneider of Standard <br />Oil co, will be meeting with him in order to work out a retention <br />system for new station being planned at Clague and Lorain. <br />Mrs. Traczyk questioned if new driveway from proposed Mongello office <br />building wi,ll add to traffic congestion. She was advised that this <br />type of office will not generate a large traffic increase. <br />Mr. Morgan still has concerns regarding the Rini proposal. Mr. Dubelko <br />stated that Great Northern Partnership has taken legal action against <br />the city and restraining any city body from taking further action. <br />Commission then discussed the possible removal of the limited access <br />restriction on Brookpark Rd. and how city can attempt to request the <br />State to retain it; if speed limit could be lowered if limited access <br />remains; what control city would have if status is changed; if side- <br />walks could be installed. Access road parallel to Brookpark was <br />also considered. Law Director Dubelko will research procedures for <br />petitioning the State and Mr. Roberts will chair committee to inves- <br />tigate options concerning Brookpark Road. Mr. Morgan and Mrs. Traczyk <br />will serve with him. Mr. McDermott will furnish a map of the SR252 <br />extension, Lorain Rd. and Brookpark Road area. Committee members would <br />like to'meet with Building Commissioner Gundy on the Rini's property <br />' on Sunday, November 2oth at 2 p.m. They request that Mr. Gundy re- <br />calculate parking requirements.
