. .: , PLANNING COMMISSION DECEMBER 13, 1983 PAGE 2 <br />(2) Rini's Supermarket, 26035 Lorain Rd. <br />Proposal to construct addition to supermarket. <br />Approved by Architectural Board of Review November 28, 1983. <br />Building Commissioner Gundy advised that parking has been recalcu- <br />lated and 565 spaces are required and planned; addition consists of <br />9,000 sq. ft. of which 3,400 sq. ft. is planned as sales area and <br />so 23 extra spaces would be required. Commission studied Archi- <br />tectural Board of Review Minutes. Mr. Draeger, architect, advised <br />if they cannot get permission from State to landscape right-of-way <br />they will reduce addition by 2' in order to install a landscape <br />strip. Mr. Richland of Great Northern Partnership again stated <br />their opposition to the encroachment into the 50 foot set back <br />along Brookpark Rd. He also questioned percentage of new sales <br />area as applies to parking requirements. Mr. J. Martindale, at- <br />torney for Great Northern,introduced himself to the Commission and <br />reiterated their objections. Members stated positions: Mr. Roberts <br />- favors maintaining 50' set back since this is the intent of Zoning <br />Codes; Mr. Burns - Board of Zoning Appeals had denied a variance in <br />August, prior to upholding Law Department ruling that Brookpark front- <br />age should be considered a rear yard; Mr. Morgan - Council did not <br />act on the ruling within the prescribed 30 days, however, a motion <br />unanimously approved by Coumcil on November 16th stated that the <br />action taken by the Board of Zoning Appeals is not determinative of <br />setback requirements because Section 1125.62 and 1174.02 require a <br />fifty foot setback from any street line in all properties zoned <br />retail and said ordinance controls on this issue; Mr. Gorris - this <br />'would set a precedent along Brookpark Road which is not fully de- <br />veloped. Mr. Draeger stated that the City's Legal Counsel ruled <br />that the 501 setback does not apply and that this should not be an <br />issue at this point. T. Morgan moved that the proposal to construct <br />an addition to the Rini's Supermarket be rejected because it is not <br />in keeping with and does not conform to the orderly development of <br />land along Brookpark Road and also does not conform to the existing <br />ordinance 1174.02 requiring a fifty (50) foot set back from any <br />street line in all properties zoned retail. This motion shall not <br />be interpreted that the Planning Commission finds fault with the <br />expansion of the existing Rini's Supermarket as contained in this <br />addition, but rather with its placement, seconded by E. Traczyk, <br />and unanimously approved. <br />Mr. Gundy advi'sed that the southern section of relocated 252 was ready <br />to be recorded, and it will be filed as S.R. 252, relocated. It will <br />be up to the City to name this.road which will connect to the old. <br />Columbia Road. J. Wixted moved to table discussion of name for re- <br />located S.R. 252, seconded by J. Roberts, and unanimously approved. Mrs. <br />Brown will chair a committee and check with Olmsted Township regarding <br />their thoughts on a name. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />Councilman Woerpel asked, informally, what Planning Commission's opinion <br />would be regarding proposal to rezone property located beside Gold Circle
