PLANNING COMMISSION DECEMBER 13, 1983 PAGE 3 <br />on Brookpark extension to General Retail, Business. Property has been <br />subdivided from parcel facing, Dover Center with existing house. The <br />frontage of the irregular shaped lot is already zoned General Retail. <br />Lot area conforms to zoning.requirements. Commission is concerned that <br />this could set a precedent since adjacent property owners could request <br />rezoning of back land. Mr. Dibenedetto, the owner, stated that when <br />the abutting land was rezoned and Brookpark Ext. was constructed, this <br />portion was left residential due to an error in the legal description. <br />Commission would like proposal to be presented as an agenda, item so <br />there can be notification of neighbors. There will also be a public <br />hearing if and when legislation for rezoning is presented to Council. <br />V. COMMUNICATIONS: <br />No Items <br />VI. NEW BUSINESS: <br />Councilman Woerpel advised that there will be no BZD Committee meeting <br />in December since he will not be sitting on Council after the first of <br />the year. B. Gorris moved that the next meeting be delayed until the <br />normal meeting in January since there will be no BZD meeting in Decem- <br />ber,?/seconded by J. Brown, and unanimously approved. <br />P,P/JP- ro DuYc' yJtFf/NG <br />The Commission commended Mr. Woerpel on the great job he had done <br />specifically in improving communications between Planning Commission <br />and the BZD Committee. His input and presence will be sorely missed. <br />VII. OLD BUSINESS: <br />Ord. 83-124: Councilman Woerpel explained that the present code does <br />not address gas station canopies and any canopy must now conform to the <br />50' set back. Most canopy requests must be referred to the Board of <br />Zoning Appeals for variances. Commission had many questions. They <br />believed that some restriction on signage should either be addressed <br />in this Ordinance or by amending the Sign Ordinance. They would also <br />like some height restrictions listed. Mrs. Traczyk questioned if light- <br />ing should be considered since it would be feasible that some proposals <br />might include lighting columns of canopies. Mr. Roberts believed that <br />it might be better to leave the situation as is, so that most proposals <br />for canopies do have to be reviewed by the Board of Zoning Appeals. <br />They also questioned why Ordinance was introduced under Chapter 1241, <br />'MiscelTaneous. B. Gorris moved that Ord. 83-124 be referred back to <br />the BZD Committee for.consideration of height and signage restrictions, <br />and to determine if proper section number was used, and if the committee <br />might have any thoughts regarding lighting of such canopies, seconded <br />By E. Tracayk. Roll call on motion:. Gorris, Traczyk, Burns, Wixted, <br />Brown, and Morgan, Aye. Roberts, Nay. Motion passed. Ord. 83-137: This will require a 50' rear set back in the General <br />Retail District. Commission believes that this would be too restrictive, <br />especially where commercial properties are back to back. Mr. Burns sug- <br />gested that since the intent of the Ordinance is to keep buildings 50' <br />from streets (mainly the Brookpark-Lorain triangular area), the ambiguity
