BOARD OF ZONING APPEALS' NOVEMBER 10, 1982 PAGE 2 <br />with the condition that the shed be only 8' high, it must meet all codes, <br />and it cannot be used for a garage at any time, seconded by R. Bugala, <br />and unanimously approved. Variance granted. <br />3. H. & R. Block, 25170 Lorain Rd. <br />Withdrawn by appellant. <br />4. William Bauer, 5789 Wellesley <br />Request for variance (1133.13). Request 1'8" sideyard variance for <br />j second chimney. Violation of Ord. 62-33, Section 1161.01. <br />v <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered. It was clarified that this is for a second chimney and <br />that there is another chimney on the property. R. Bugala moved to grant <br />the 1'8" sideyard variance, seconded by L. Horvath, and unanimously <br />approved. Variance granted. <br />5. Philip Brzeski, 4702 Fleharty <br />Request for variance (1133.13). Request 4'6" rear yard variance. Vio- <br />? lation of Ord. 62-33, Section 1163.01. Also request 6'6" variance for <br />distance between proposed addition and existing garage. Violation of <br />Ord. 62-33, Section 1151.04C. <br />Chairman Remmel called all interested parties before the Board. The oath <br />was administered to Mr. & Mrse Brzeski and the contractor. The agenda <br />was corrected: address is 4702.Fleharty. Upon examining the site plan, <br />Mr. Gundy stated that a 5' variance would be required. C. Remmel moved <br />to grant the two variances requested, changing the one to 5' instead of <br />4' 611, seconded by T. Restifo, and unanimously approved. Variances <br />granted. <br />6. Herman Wearsch, 23396 Marion Rd. <br />J Request for variance (1133.13). Request 3' sideline variance for garage. <br />Violation of Ord. 62-33, Section 1151.04C <br />Chair-man Remmel called all interested parties before the Board. The oath <br />was administered. The Board believes that 3' sideyards are necessary for <br />maintenance. Mr. Wearsch agreed to ammend his application to request a <br />2' variance. C. Remmel moved to grant a 2' variance, seconded by E. Graves, <br />and unanimously approved. Variance granted. 7. Betty Svozil, 5156 Whitethorn " <br />J Request for variance (1133.13)- Request 13' rear yard variance for ad- <br />dition. Violation of Ord. 62-33, Section 1163.01. Also request 7' vari- <br />ance for distance between proposed addition and detached garage. Violation <br />of Ord. 62-33, Section 1151.04. Also request Special Permit to add to <br />non-conforming dwelling (49' rear yard). Special permiss,ion required . <br />Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. It was <br />explained that this will be a glassed in porch and has been designed to <br />match the house. R. Bugala moved to grant the variances for Betty Svozil,
