Special permission required <br />Ord. 62-33, Section 12.31.02. <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered. Building Commissioner Gundy advised the Board <br />that this would require fire rated dry wall. E. Graves moved to grant <br />the Special Permit, seconded by T. Restifo, and unanimously approved. <br />Special Permit granted. <br />9. Blackbriar Inn (J. Hanslik & R. Parker), 28253,Lorain Rd. <br />Request for variance (1133.13). Request variance to sell liquor less <br />? than 500 ft from North Olmsted City Park. Violation of Ord. 62-33, <br />? Section 1173.02-CO1. Also request variance for parking area (19 spaces <br />less than required). Violation of Ord. 62-33, Section 1213.02R. <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered to Mr. Henslik, Mr. Parker, Councilman D. McKay, <br />Parks and Recreation Commission and neighbors. Mrs. Simonyi and Mrs. <br />Allen. Mr. Hanslik and Mr. Parker explained that at the present lo- <br />cation the operation is mainly that of a tavern, but at the new loca- <br />tion the operation will be more of a restaurant. The distance from the <br />park is 454 feet. There is another bar which is probably closer to the <br />park, but it has been in existance prior to the ordinance. The owners <br />stated that the parking was figured on the square footage of the area <br />and much of the space is used for hallways and restrooms; and that <br />there will only be 92 seats which would require 48 parking spaces if <br />the parking could have been figured on that basis. Councilman McKay <br />advised that the Parks and Recreation Commission was opposed to the <br />variance because of the closeness to the park, and because of the <br />carry out license since drinks could be .purchased and taken to the <br />" park and also, overflow parking could possibly use the park. Mr. Wasniak, <br />also from the Parks Commission, had called to raise his objections. <br />Neighbors have concerns that this operation.will devaluate their pro- <br />perty and that overflow parking could cause them problems. Mrs. Allen <br />was advised that the vacant lot next to her could not be made into a <br />parking lot without a variance. T. Restifo moved to grant the variances, <br />seconded by R. Bugala. Roll call on motion: Restifo, Bugala, Remmel, <br />Graves, and Ho.rvath, Nay. Motion failed to pass. Variances denied. <br />10;?
