BOARD'OF ZONING APPEALS SEPTEMBER 1, 1982 <br />4. Joseph G. Kapostasy, 23235 Mildred <br />? Request for variance (1133.13). Request 3' rear yard variance <br />Violation of Ord. 62733, Section 1163.01. Also request Special <br />to non-conforming building (front setback). Special permission <br />Ord.62-33, Section 1231.02. <br />PAGE 2 <br />for addition. <br />Permit to add <br />required, <br />C. Remmel invited all concerned to stand before the Board. Applicants were <br />sworn in. The Board noted the large ditch and undeveloped land extending beyond <br />the rear yard, and will have no effect on adjacent property. It was moved by <br />C. Remmel to grant the request, seconded by L. Horvath, and unanimously ap- <br />proved. <br />5. George T. Gilby, 5621 Dorothy Dr. <br />j Request for variance (1133.13). Request 7.1' rear yard variance for patio <br />enclosure. Violation of Ord. 62-33, Section 1163.01. <br />C. Remmel invited all concerned to stand before the Board. Applicants were <br />sworn in.. The Board discussed the site inspection, no objection for patio <br />cover only. It was moved liy L. Horvath to grant the request conditional on <br />the roof only, and it was seconded by R. Bugala, and unanimously approved. <br />6. Ella Louise MacDougall, 24337 Woodmere <br />? Request for variance (1133.13). Request 10' rear yard variance for porch. <br />Violation of Ord. 62-33, Section 1163.01. <br />C. Remmel. invited all concerned to stand before the Board. Applicants and <br />Mr. K1uth were sworn in. The Board has no problem to the rear of this property. <br />It was moved. by._R: Bugala to grant the request, seconded -by L. ,Horvath; and <br />unanimously approved. . <br />? 7. /- T. M. Hupperich, 3226 W. 230th St. / Request for variance (1133.13). Request 36-1/2' variance for length of privacy <br />v screen, and also, request variance for location of privacy screen (14-1/2' <br />privacy screen was existing when 36-1/2' was installed on property line.) <br />Violation of Ord. 62-33, Section 1151.04G. <br />C. Remmel invited all concerned to stand before the Board. Applicant and <br />neighbor were sworn in. It was established that the fence has been installed <br />without a permit and in violation of the Zoning Code.. The date of installation <br />was never made known. Neighbor Sam Costanzo has no objections. Mr.'Hupperich <br />came forward and identified himself and co-owner of the property. Before <br />testimony he was sworn in by C, Remmel. Mr. Hupperich stated that his under- <br />standing of the code permitted privacy screen 6' high in patio azea locations. <br />The Code was explained by the Board and ex isting violations noted. It was <br />moved by C. Remmel,to grant the request conditional on the painting or staining <br />both sides within 30 days from this date, seconded by L. Horvath, and unanimously <br />approved. <br />8. Daniel J. Bewley, 5833 Columbia Rd. <br />Request for variance (1133.13). Request 210 sq.ft. variance for garage addition. <br />Violation of Ord. 62-33, Section 1151.04C. Request Special Permit to add to non- <br />conforming dwelling. Special permission requit.ed Ord. 62-33, Section 1159.01.
