<br />BOARD QF ZONING APPEALS SEPTEMBEP, lt 1982 <br />PAGE 4 <br />C. Remmel invited all concerned to stand before the Board and be sworn in. <br />The Board considered and discussed the need for privacy. R. Bugala moved to <br />grant a 1' height variance from the rear building line house proper to the <br />rear building line of the added family room as shown on the plans, seconded <br />by L. Horvath, and unanimously approved. <br />13. Jerry Johnsen, 3399 Hunter Dr. <br />Request for variance (1133.13). Request 20 sq. ft. variance and location <br />!-'J variance for tool shed. Violation of Ord. 62-33, Secti9n 1151.04D. <br />C. Remnel invited all concerned to stand before the Board and be sworn in. <br />In attendance were Mr. & Mrs. Johnson, Mr. Finlan, and Attorney R. Ruppert <br />representing Mr. Finlan. Attorney Ruppert mentioned the initial objection <br />to this variance is the applicants failure to identify the reasons for his <br />request and further mentions their objection to the location which will <br />diminish property values because of its unsightly nature. Law Director Gareau <br />responded to Mr. Rupperts remarks stating the Board is obligated to not <br />deprive the homeowner of his property rights and to stay within the spirit of <br />the code. Mr. Johnson.feels that 2.5' property line separation will be suf- <br />ficient to maintain the area and moving the shed as requested will substantially <br />decrease his garden. Member R. Bugala sees no specific hardship. It was moved <br />by C. Remmel to grant a 2.5' rear and side yard variance, seconded by L. Horvath. <br />Roll call on the motion, C. Remmel yes, L. Horvath yes,.Bugala no, motion failed. <br />It was then moved by C. Remmel to grant a 20 square ft. variance on size,seconded <br />by R. Bugala. Roll call on the motion was, C. Remmel no, R. Bugala no. Horvath <br />no, motion failed. <br />14.i J. Horvath &.A.ssociates, 30850 Lorain Rd. (Timber Trails Party Center) <br />j Request for variance (1133.13). Request 1.6 sq.ft.variance for addition to <br />P existing pole sign. Violation of Ord. 62-33, Section 1126.01F4. <br />C. Remmel invited all concerned to stand before the Board and be sworn in. <br />Sign contractor T. Guggenbiller considers the request small, will blend with <br />existing ; and otherwise conforms. The Board suggested the use of a ground <br />sign wliich will not require a variance. C. Remmel moved to grant the request, <br />seconded by R. Bugala. Roll call on the motion was, C. Remmel no, R. Bugala <br />no, L. Horvath yes. The request was denied. <br />15. Carolynn Muldoon, 28120 N. Park Dr. <br />Request Special Permit. (1231.02). Request Special Permit to add to non-conform- <br />? ing dwelling (front set back). Special permission required Ord.62-33,Section <br />1231.02. <br />C. Remmel invited all conerned to stand before the Board and be sworn in. <br />The applications and site inspection by the Board was discussed. L. Horvath <br />moved to approve the request, seconded by C. Remmel, and unanimously approved. <br />16. R: George, 3984 Deepwoods <br />Request for Ruling (1133.11). Request ruling if sections of fence installed <br />should be considered a fence or a landscape feature.
