BOARD OF ZONING Af'PEnLS JULY 7, 1982 PAGE 3 <br />cover and partially enclose deck. Violation of Ord. 62-33, <br />Section 1159.02. Also, requeSt for 5' variance for distance be- <br />tween house and garage. Violation of Ord. 62-33, Section 1151.04C. <br />Also request Special Permit to add to non-conforming dwelling. <br />Special permission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. <br />The oath was administered. It was explained that this is a 2 level <br />deck and the first level will be partially enclosed with a louverd <br />wall. L. Horvath moved to grant the variances and the Special <br />Permit, seconded by C. Kemmel, and unanimously approved. Variance <br />granted. <br />8. Michael Richardson, 5820 Dorothy Dr. <br />Request for ruling (1133.12). Request ruling to a11ow construction <br />of gazebo. Not a specific permitted use in a residential area. <br />Chairman Remmel called all interested parties before the Board. <br />The oath was administered. The Board was reluctant to issue a <br />ruling which would set a precedent. They would like to have an <br />opportunity to rule on each one individually. M. Gareau advised <br />that a variance could be granted to permit a.gazebo as a special <br />use in a residential district. C. Remmel moved to grant the vari- <br />ance for a special use in a residential district to cover rfr. <br />Richardson's gazebo, seconded by E. Graves, and unanimously ap- <br />proved. Variance granted. <br />9. Michael Kopach, 23406 Stoneybrook Dr. <br />J Request for variance (1133.13). Request 222` variance for length <br />of privacy screen. Violation of Ord. 62-33, Section 1151.04G <br />Chairman Kemmel called all interested parties before the Board. <br />The oath was administered. Mr. Kopach explained that the screen <br />was to surround his patio which is approximately 18" to 20" higher <br />than the surrounding land. He pointed out that only 16' would be <br />visible on one side and only 222 will be visible on the other side. <br />C. Remmel moved to grant the variance, seconded by L. Horvath. Roll <br />call on motion: Remmel, Horvath, Graves, Aye. Wasniak, Nay. Vari- <br />ance granted. <br />10. Brian Novick, 4169 Clague Rd. <br />j Request for variance (1133.13). Request 11'2" variance for dis- <br />? tance between house and garage. Violation of Ord. 62-33, Section <br />1151.04 C. <br />Chairman Remmel called al1 interested parties before the Board. <br />The oath was administered. It was observed that this is a small lot <br />and the addition would be close to the house next door. W. Wasniak <br />moved to grant the variance, seconded by C. Remmel. Roll call on <br />motion: Wasniak, Remmel, Graves, and Horvath, Nay. Motion failed <br />to pass. Variance denied.
