,r• • ll <br />J <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - MAY 5, 1982 <br />Chairman Remmel called the meeting to order at 7:30 p.m. <br />Present: C. Remmel, R. Bugala,.L. Horvath, and W. Wasniak. <br />Absent: E. Graves <br />Also Present: Building Commissioner E. Gundy, Law Director M. <br />Gareau, and Recording Secretary B. Oring. <br />L. Horvath moved to approve the Minutes of April 7, 1982.as presented, <br />seconded by R. Bugala, and unanimously approved. <br />Building Commissioner Gundy reported that Mr. Chris DiRuggiero, 5578 <br />Dorothy Dr. had reduced the,height of his garden shed as required <br />by the variance granted on December 2, 1981. The shed now conforms <br />to the variance and the other regulations of the City. <br />1. Gordon Jedd, 24997 Mitchell Dro <br />Request Special Permit to add to non-conforming dwelling (40' rear <br />yard). Special Permit required by Ord. 62-33, Section 1231.02. Re- <br />quest for variance (1133.13). Request 10' rear yard variance for <br />porch enclosure. Violation of Ord. 62-33, Section 1163.01. <br />Chairman Remmel called all interested part-ies before the Board. The <br />oath was administered. It was observed that,the property to the rear <br />is zoned for multi family and that the house to the west extends out <br />at least 12' further than this house. R. Bugala moved to grant the <br />Special Permit and the 10' variance for Gordon Jedd, seconded by L. <br />Horvath,.and unanimously approved. Variance and Special Permit granted. <br />2. Ronald Stecklow, 27460 Lusandra Circle . <br />Request for variance (1133.13). Request variance for location of <br />solid fence for swimming pool on corner lot. Violation of Ord. 62-33, <br />Section 1151.04H and.1151.04 L. <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered. Mr. Stecklow.explained that the portion of the <br />fence on the side street would not be solid but rather board-on-board, <br />however, this would not be 90% open as required by Ordinance. At this <br />point Mr. Remmel administered the oath to both Mr. Stecklow and his . <br />neighbor, Mr. Tomcik. Mr. Remmel and Mr. Bugala both agreed that a <br />board-on-board fence would block vision from Mr. Tomcik's drive. Mr: <br />Tomcik does not want a cyclone fence adjacent to his property; he much <br />prefers a wood fence. C. Remmel moved to grant the variance for a <br />board-on-board fence for 20' on the northwest side, and both street <br />_ sides, seconded by -W.. Wasniak. -Roll call on -motion: Remmel and Horvath, <br />aye. Bugala and Wasniak, Nay. Motion failed to pass. Variance denied. <br />? 3. Ruth Love, 4933 Grace Rd. , <br />Request for variance (1133.13).. Request 1° height variance for fence <br />and 32 height variance for solid fence in front set back (not 50%open) <br />Violation of Ord. 62-33, Section 1151.04H.
