,r• • ll J CITY OF NORTH OLMSTED BOARD OF ZONING APPEALS MINUTES - MAY 5, 1982 Chairman Remmel called the meeting to order at 7:30 p.m. Present: C. Remmel, R. Bugala,.L. Horvath, and W. Wasniak. Absent: E. Graves Also Present: Building Commissioner E. Gundy, Law Director M. Gareau, and Recording Secretary B. Oring. L. Horvath moved to approve the Minutes of April 7, 1982.as presented, seconded by R. Bugala, and unanimously approved. Building Commissioner Gundy reported that Mr. Chris DiRuggiero, 5578 Dorothy Dr. had reduced the,height of his garden shed as required by the variance granted on December 2, 1981. The shed now conforms to the variance and the other regulations of the City. 1. Gordon Jedd, 24997 Mitchell Dro Request Special Permit to add to non-conforming dwelling (40' rear yard). Special Permit required by Ord. 62-33, Section 1231.02. Re- quest for variance (1133.13). Request 10' rear yard variance for porch enclosure. Violation of Ord. 62-33, Section 1163.01. Chairman Remmel called all interested part-ies before the Board. The oath was administered. It was observed that,the property to the rear is zoned for multi family and that the house to the west extends out at least 12' further than this house. R. Bugala moved to grant the Special Permit and the 10' variance for Gordon Jedd, seconded by L. Horvath,.and unanimously approved. Variance and Special Permit granted. 2. Ronald Stecklow, 27460 Lusandra Circle . Request for variance (1133.13). Request variance for location of solid fence for swimming pool on corner lot. Violation of Ord. 62-33, Section 1151.04H and.1151.04 L. Chairman Remmel called all interested parties before the Board. The oath was administered. Mr. Stecklow.explained that the portion of the fence on the side street would not be solid but rather board-on-board, however, this would not be 90% open as required by Ordinance. At this point Mr. Remmel administered the oath to both Mr. Stecklow and his . neighbor, Mr. Tomcik. Mr. Remmel and Mr. Bugala both agreed that a board-on-board fence would block vision from Mr. Tomcik's drive. Mr: Tomcik does not want a cyclone fence adjacent to his property; he much prefers a wood fence. C. Remmel moved to grant the variance for a board-on-board fence for 20' on the northwest side, and both street _ sides, seconded by -W.. Wasniak. -Roll call on -motion: Remmel and Horvath, aye. Bugala and Wasniak, Nay. Motion failed to pass. Variance denied. ? 3. Ruth Love, 4933 Grace Rd. , Request for variance (1133.13).. Request 1° height variance for fence and 32 height variance for solid fence in front set back (not 50%open) Violation of Ord. 62-33, Section 1151.04H.
