BOARD OF ZONING APPEALS MAY 5, 1982 PAGE 2 <br />Chairman Remmel called all interested parties before-the Board. fihe <br />oath was administered. Mrs. Love's property adjoins Interstate 480. <br />Mr. Remmel advi'sed Mrs. Love that the City is considering a project to <br />create,some sort of barrier between the freeway and the adjacent pro- <br />perties. R. Bugala moved to approve the variance for Ruth Love, sec- <br />onded by L. Horvath, and unanimously approved. Variance granted. <br />4.* Richard Tabar, 23044 MacBeth • <br />Request Special Permit (1231.02). Request.Special Permit for addition <br />(dormer) to non-conforming.dwelling. Special Permit required Ord. 62-33, <br />Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered._ This project is under construction because Mr. <br />Tabar had started to remove the shingles before he was advised that he <br />mould need a Special Permit. It was observed that the addition would <br />be an improvement. C. Remmel moved to grant the Special Permit, <br />seconded by L. Horvath, and unanimously approved. <br />5. Donald and Margaret Komar, 4472 Lansing Dr. <br />Request for variance (1133.13)a Request 1' height variance for fence. <br />Violation of Ord. 62-33, Section 1151.04. " <br />Chairman Remmel called all interested parties before the Board. The <br />oath was administered. Mr. Danzey, the adjacent neighbor, objected to <br />the fence because it will curtail the sunlight on his garden, will cut <br />down air flow, and;since his property is lower and the fence will <br />be in the swale,it will impede drainage. There has been flooding <br />previously. Other progerty owners present, Mr. R. Edkin and R. Fry, <br />also opposed the fence since it would ruin the park like area, and <br />reduce the air flow. Mr. and Mrs. Komar stated that they are planning <br />to bring the fence in at least 8 to 12:' from the property line to allow <br />extra sunlight to fall on Mr. Danezy's garden, also, the fence will _ <br />only extend back 200'. in order to obscure.the barn which is on the <br />Danzey's property. C.°Remmel moved to grant the variance, seconded by <br />L. Horvath. Roll call on motion: Remmel, Bugala, and Wasniak, nay. <br />Horvath, aye. Motion failed to pass. Variance denied. <br />6. Florentino Morales, 6231 Barton Rd. <br />., Request Speci.al Permit to add to non-conforming dwelling (front-set <br />back). Special Permit required Ord. 62-33, Section 1231.02. Also <br />request for variance (1133.13). Request 29'6" front set back vari- <br />ance for addition. Violation of Ord. 62-33, Section 1159.01. <br />Chairman Re-el called all.interested parties before the Board. The <br />oath was administered. The new addition will block the present access <br />to the garage, and Mr. Morales plans to builld a new garage and driveway <br />on the opposite of the house later on. He will rebuild the existing <br />front porch next year. Mrs. Thorpe, representing the North Olmsted <br />Congregational Church, which is.next door, presented a statement in <br />favor of the Special Permit. Mr. Morales does not want to remove the <br />front porch which is within 139 6" of the sidewalk. Building Com- <br />missioner Gundy stated that architecturally he would have problems re- <br />moving.it because of the roof line. Mr. Morales agreed to repair the
