l
1 . PLANNING COMMISSION MARCH 23, 1982 PAGE 2
and 2 had been ammended by the Review Board to shorten the
overhang of the roof instead of bringing out the concrete
curbing and the window in order to prevent large vehicles
from hitting the overhang. He agreed that he would modify
the plans so that high vehicles would not be a problem. In
reference to #2 Spudnuts has agreed to the exit and entrance
signs on the driveways, however the "exit only" sign on
Whitethorn will not be lighted (there was no recommendation
for lighting these signs by the Review Board). Regarding
the 7th stipulation, Mre Leonard stated that he had plarined
to prepare and paint the rear wall to match the stucco board
and the trim but that the cost of finishing the rear wall
with the stucco and cedar would be prohibitive. He also
pointed out that the high shrubs would help conceal this
wall. He cannot positively guarantee that the metal paint
would not peel, but since this store will be a proto-type
for other stores which will be built in this area, he is
certain that Spudnuts will maintain the property. Mr.
Prokasy observed that this is leased property and that
Spudnuts was renovating it wo that it would be a great im-
provement over the present building which is unoccupied and
deteriorating and that the cost is a consideration. As for
the 9th recommendation, Mr. Leonard stated that the roof
would be elevated on three sides so that the mechanical
equipment would not be totally exposed. He planned to paint
them to match the roof, and did not think they would be
noticeable. J. Prokasy moved to approve the Spudnuts, Inc.
proposal with the March 15, 1982 recoinmendations of the
Architectural Board of Review numbers 3, 4, 5, 6, and 8,
and with the notation that the overhang of the roof could be
shortened 1 foot. In reference to recommendation #7 we
concur with Mr. Leonard, the Architect, that_the rear wa11
can be prepared and repainted with metal paint and concealed
with shrubs and that also we recommend that recommendation #9
referring to the mechanical equipment on the roof, that this
equipment can be painted to match the roof so as not to be
too noticeable, seconded by J. Burns. Roll call on motion:
Prokasy,.Burns, Brown, and Gorris, Aye. Perla, Nay. Motion-
passed. Assistant City Engineer D. McDermott stated that
since this property has not been assembled, the Engineering
Department would delay its approvals until the assembly plat
is submitted by the owner of the property, and also that the
City is requesting that a small portion of the land be dedi-
cated to the City for right-of-way at the intersection of
Whitethorn and Lorain. He also pointed out that there was
an error in the original survey. These matters must be
handled by the owner of the property,.not Spudnuts. J.
Prokasy moved that also in reference to Spudnuts, it be
brought to the attention-of City Council that the Engineering
Department requires the assembly of the 2 lots and is re-
questing additional right-of-way on the south west corner of
the site, seconded by R. Perla, and unanimously approved.
