Mr. Gundy stated <br />that the Board had ruled on the use of the land, not on the <br />specific plans that were presented to them and they had <br />made comparisions that this proposal was a like and similiar <br />use to a hotel, motel, hospital, convalescent nursing home, <br />. or custodial rest home. The Board of Zoning Appelas did <br />not address itself to any particular sideyards in its motion. <br />Mr. Gundy advised that there is no 50' side yard required in <br />the code for a Group/Family Home for the Retarded and that <br />the front set back is proper for a-General Retail District <br />and that the side yards in a commercial area are normally <br />determined by the State Building Code, and this proposal <br />conforms to that. Councilman Wilamosky stated that he is. <br />requesting if the Zoning Board of Appeals comparision of <br />a like and similar use was to a convalescent home or a <br />motel/hotel and that he would like an opinion as to which use <br />it should be compared to specifically. The Board of Zoning - <br />Appeals motion did not compare this proposal to any one spe- <br />cific use. Chairman Gorris agreed that the question of use <br />is out of the Commission's hands since the Board of Zoning <br />Appeals made a decision, however, it is encumbent upon this <br />body to ensure that how the property is laid out is in con- <br />formance with all the applicable zoning regulations of the <br />City. Assistant Law,-Dii-ector Dubelko stated that this rul- <br />ing may possibly be appealed to the courts and the project <br />delayed. However, this issue is coming before the Planning <br />' Commission to ensure that the proposed additions were in con- <br />formance with the codes. At this time he would like to review <br />the proposed use with all the various code requirements. He <br />agreed that the Commission cannot review the Board of Zoning <br />Appeals, however they do review code requirements. J. Prokasy <br />moved to refer the West Haven Foundation proposal to the Law <br />Department for their ruling on the validity of these plans <br />per the Zoning Board of Appeals recommendations, seconded by <br />J. Roberts, and unanimously approved. J. Prokasy moved to <br />refer the West Haven Foundation plans to the Architectural <br />Baard of Review, seconded by J. Roberts, and unanimously <br />approved. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />No Items <br />V. CQMMUNICATIONS: <br />No Items <br />VI. NEW BUSINESS: <br />The el:ections June 8, 1982 will interfem with the Planning Commis= <br />~ sion Meeting. That meeting wi11 be tentatively scheduled for <br />Wednesday, June 9th.
