N0. 82.-85: AN ORDINANCE AMENDING THE ZONING CODE OF THE <br />CITY OF NORTH OLMSTED BY AMENDING SECTION 1174.10 ENTITLED <br />"REGULATIONS REGARDING THE INSTALLATION OF OUTDOOR TELEPHONE <br />PAY STATIONS" OF CHAPTER 1174 ENTITLED "HEIGHT AND AREA REGU- <br />LATIONS FOR RETAIL BUSINESS DISTRICTS" <br />Councilman Woerp:el explained that this Ordinance eliminates the <br />25' set back requirement for outdoor structures, the 5' side yard <br />requirement, and the necessity for 2 parking spaces for each tele- <br />phone. The written statement of approval from the owner of the <br />property will not have to be notarized. Also paragraph C'makes <br />the :Ohio Bell Telephone and the owner of the property jointly <br />responsible for keeping the equipment in working order and the <br />area free of litter'and debris. Failure to comply could incur <br />a$50.00 fine and/or removal of structure. A representative <br />of Ohio Bell explained the problems with the present Ordinance. <br />Pending agplications were presented to the Commission as an ex- ample of the many applications on file. The Commission.questioned <br />the nlunber of outdoor telephones needed in North Olmsted;:and they <br />also noted the the Ordinance names Ohio Bell Telephon Co. specif- <br />ically and they suggest the Ordinance state "telephone company". <br />The Commission suggested that the BZD Committee request a survey <br />from Ohio Bell Telephone Co. as to location of all existing out- <br />door telephone.structures in North Olmsted. J. Burns moved to <br />accept Ord. 82-85 as submitted with the proposed changes in Item <br />C to read: The applicant and the telephone company supplying the <br />service shall jointly be responsible for the proper maintenance <br />of the structure and the immediate area within which it is in- <br />stalled, including maintaining the equipment in working condition <br />and keeping the immediate area of.the equipment free of litter <br />and debris. Failure to provide proper maintenance and cleanli- <br />ness may result in a fine of not less than Fifty Dollars ($50.00) • <br />per day and/or the removal of the structure, seconded by R. Perla, <br />and unanimously approved. <br />A letter from Mr. Woerpel, Chairman of the BZD Committee, request- <br />ing a review by Planning Commission of possible zoning changes. <br />Mr. Morgan will chair the committee and Mr. Perla will serve on <br />the ad hoc committee. <br />VI. NEW BUSINESS: <br />Mr.- Morgan commended Councilman Woerpel for his attendance at <br />Planning Commission meeting since this facilitates communications <br />between BZD and Planning Commission.
