Horvatn, and W. Wasniak <br />Also Present: Building Commissioner Gundy, Law Director M. Gareau, <br />and Recording Secretary B. Oring • <br />L. Horvath moved to approve the Minutes of August 5, 1981 and the <br />Minutes of the Special Meeting of August 17, 1981, as submitted, <br />seconded by W. Wasniak,and unanimously approved. <br />1. Fred and Neil Bower, permanent parcel 235-12-41 & 42, located north <br />of 5532 Burns Rd.' <br />Withdrawn from August meeting. Request for variance (1133.13). <br />Request 10' variance for front set back to construct single <br />dwelling. Violation of Ord. 62-33, Section 1159.01. Assembly plat <br />heard by Planning Commission 7/28/81. <br />-- Chairman Remmel called all interested parties before the Board. <br />The oath was administered. Mr. Bower explained that because of <br />a ditch running through the property there was no way that they <br />could build on the lot and observe the 50' set back. He pointed <br />out that they had combined two 40' lots so this now had an 80' <br />frontage.and that the original subdivision plat showed a 25' front <br />set back which does not conforrs to the zoning codes. L. Horvath - <br />? moved to grant the request based on the fact that the variance <br />' would be granted on an 80' frontage of the combined lots, seconded <br />by W. Wasniak, and unanimously approved. Variance granted. <br />2. Ed Share, 23253 Clifford <br />Request for variance (1133.13). Request 9' variance for distance <br />between addition and existing garage (on property). Also 10° , <br />variance for distance between addition and adjacent garage. Vio-, <br />lation of Ord. 62-33, Section 1151.04-C. Also request Special <br />Permit to add to non-conforming dwelling (front set back). <br />Special permission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel called all interested parties before the Board. <br />The oath was administered. This is for a 4' addition and Mr. <br />Share submitted a statement signed by his neighbors agreeing to <br />the addition. It was suggested that Mr. Share could move the <br />garage since there was ample room in the rear of the lot. W. <br />Wasniak moved to grant the variance, seconded by L. Horvath. <br />Roll call on Motion: Wasniak and Remmel, Nay. Horvath, ayee <br />., Variance denied. <br />r
