CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - SPECIAL MEETING <br />AUGUST 17, 1981 <br />Chairman Remmel called the meeting to order at 7:30 p.m. z <br />Present: C. Remmel, L. Horvath, and W. Wasniac <br />Also Present: Building Commissioner E. Gundy, Councilwoman <br />Y. Petrigac, and Recording Secretary B. Oring <br />The Minutes of August 5, 1981 were deferred until the next <br />regular meeting. <br />1. Horvath Building Co., Sublot 6 Newton Circle <br />Appeal concerning placement of dwelling. Appeal made under <br />Ord. 62-33, Section 1133.07. <br />Chairman Remmel called all interested parties before the Board. <br />The oath was administered. Mrs. Nita Young of 26989 Sweetbriar Dr. <br />is objecting to the house under construction by Horvath Building Co. <br />since at one point the foundation is only 28' from her rear property <br />line. It was pointed out that this is an irregular shaped lot and <br />that the extreme depth of the rear set back is 85' and the shortest <br />point is 28' and the mean depth.is 57' which conforms to the Ordi- <br />nance. Mrs. Young explained that she is objecting because the <br />house is too close to her property, that the property in question <br />is higher, and this situation will devaluate her home. ,Mr. Emil <br />Horvath, the builder, explained that the m is a swale on the Young <br />property and that he has put in two yard drains and there will be <br />no water problem. Mrs. Young.feels that the'house could have been <br />placed differently on the lot. The Ordinances were explained to <br />Mrs. Young. The attorney for Mr. Horvath stated that the standards <br />set by the City Ordinances were being met and legally there was no <br />way that the City can prohibit his client from continuing to build. <br />Chairman Remmel advisedthat Mr. Lou Horvath, member of the Board, <br />was not related to nor associated with the builder Mr. Emil Horvath. <br />Mr. L. Horvath moved to grant the appeal against the Horvath Building <br />Co., seconded by W. Wasniak. Roll Call on Motion: Horvath, Wasniak, <br />and Remmel, Nay. Appeal rejected. <br />2. Shore West Construction Co., Sublot 47, Saw Mill Creek <br />Rehearing: Request for variance (1133.13). Request 8' rear yard <br />variance for construction of new home. Violation of Ord. 62-33, <br />Section 1163.01. <br />Chairman Remmel called all interested parties before the Board. <br />The oath was administered. Building Commissioner Gundy explained <br />how the rear set backs were figured. Mr.'Neil Bower explained that <br />he had interpreted the Ordinance incorrectly and did not realize
