BOARD OF ZONING APPEALS APRIL 1, 1981 PAGE 2 <br />4. Thomas & Patricia Davis, 23801 LeBern Dr. <br />Request for variance (1133.13). Request 8' 2" variance for <br />distance between house and garage. Violation of Ord. 62-33, <br />Section 1151.04-C. <br />Chairman Ledvina called all interested parties before the Board. <br />The oath was administered. It was pointed out that the addition <br />will be 11' 10" away from the garage.and that no fire wall was <br />_ actually required. but that the owner might find it saf er.tQ <br />put`one in. W. Wasniak moved to grant the variance, seconded by <br />_ L. Horvath, and unanimously approved. Variance grantedo <br />5. Eugene Sampson, 5801 Fitch Rd. <br />Request for variance (1133.13). Request 1' variance for fence. <br />Violation of Ord. 62-33, Section 1151.04 H. <br />Chairman Ledvina called all interested parties before the Board. <br />The oath was administered. The property has a very short rear <br />yard and abutts the bike path and 1480. W. Wasniak moved to <br />grant the variance, seconded by L. Horvath, and unanimously <br />approved. Variance granted. <br />6. Irv Weiss, Property in the rear of 23630, 23680, & 23570 Mastick Rd. <br />Request for variance (1133.13). Request variance to use single "A" <br />residence area for parking for apartments. Violation of Ord. 62-33, <br />Section 151.01. Also, request variance for required 20' separation <br />between multifamily and residential area for building and for parking <br />area. Violation of Ord. 62-33, Section 1159.01B. <br />Chairman Ledvina called all interested parties before the Board. <br />The oath was administered. The request was explained to the <br />neighbors. Mr: Weiss owns property which has dual zoning. The <br />front segment is zoned residential the rear is zoned multi-family. <br />There are also residential properties in front of Mr. Weiss's <br />property. He has one lot which will be used as a driveway. Mr. <br />Weiss would like to use the residential area for his parking, and <br />also the buildings will not be 20' away from the zone line. The <br />neighbors were opposed to the variance. The site plan could be <br />changed to accomodate parking on the multi-family area. D. Ledvina <br />moved to approve the variance, seconded by Horvath. Roll call on <br />Motion: Ledvina, Horvath, and Wasniak, Nay. Motion failed to <br />$ass. Request denied. <br />7. William R. Harwood, 5847 MacKenzie <br />Request for variance (1133.13). Request 6' variance for distance <br />between house and garage. Violation of Ord. 62-33, Section <br />1151.04-C.
