? <br />I <br />CITY OF NORTH OLMSTED / <br />BOARD OF ZONING APPEALS <br />MINUTES - DECEMBER 3, 1980 <br />Chairman Ledvina called the meeting to order at 7:30 p.m. <br />J <br />Present: D. Ledvina, C. Remmel, L. Horvath, E. DeVoto, and <br />W. Wasniak <br />Also Present: Building Commissioner E. Gundy, Law Director M. Gareau <br />and Recording Secretary B. Oring <br />L. Horvath moved to approve the Minutes of November 12, 1980, as <br />submitted, seconded by C. Remmel, and unanimously approved. <br />1. L. Don Shumaker, 5651 Columbia Rd. <br />Request for variance (1133.13). Request 347 sq. ft. variance for <br />garage. Violation of Ord. 62-33, Section 1151.04 C. <br />Chairman Ledvina called all interested parties before the Board. <br />The oath was administered. The request was explained to Mzs. Lappin, <br />a neighbor. Construction will be similiar to the existing stable. <br />Dr. Shumaker stated that the north wall of the garage will be the <br />same distance from the property line as the horse stable. An <br />existing shed will be moved. L. Horvath moved to grant the variance, <br />seconded by E. DeVoto, and unanimously approved. Variance granted. <br />2. Raymond and Rose Jenne (The Party Shop), 27600 Lorain Rd. <br />Request for variance (1133.13). Request variance to subdivide <br />General Retail-property (Less-than 150' f rontage and less than <br />25,000 sq. ft.). Violation of Ord. 62-33, Section 1174.03. <br />Chairman Ledvina called all interested parties before the Board. <br />The oath was administered. Mr. Calahan, attorney, explained the <br />request. The section number on the request should be changed to <br />read Section 1174.07. This request is to create-4 undersized parCelS <br />out of one with 3 existing businesses, one would be landlocked with <br />no frontage on Lorain Road with two easements for access. The Jennes <br />are requesting this to have.separate tax bills for each business or <br />for future sale of property. E. DeVoto moved to deny the variance <br />because of the variables concerned especially in light of the f act <br />that one of the reasons for subdividing is to sell and in the event <br />that it is sold the future owner will be getting into easements pro- <br />blems, title transfers etc., seconded by C. Remmel, and unanimously <br />approved. Request denied. <br />3. Richard J. Swidrak, 2896 Clague Rd. <br />Request for variance (1133.13). Request 162 sq. ft. variance for <br />garage addition. Violation of Ord. 62-33, Section 1151.04 C. <br />Chairman Ledvina called all interested parties before the Board.
